Mr. Wagner <br />commented he also felt the precedent set was ill-advised, and seconded the motion. All voted Aye. The <br />matter was tabled to the August 19 meeting. Mr. Schoomer suggested that conditions could be set when <br />the site plan is considered to help allay Council's fears. <br /> <br />LIOUOR LICENSE - 7555 OLIVE <br /> <br />The City Manager said an application to transfer the license to sell alcoholic beverages by the drink to <br />the new owners of Pier 75 was reviewed and found to be in order. The new owners and managers have <br />good records, and one of the applicants has a restaurant with a current liquor license in good standing. <br />Although there have been no major problems at this location, there have been a few minor incidents in <br />the past few years. Council may approve the license, perhaps with a notice to the applicants that they <br />are expected to operate this business in a way that will not present the community with any problems, <br />and that a strong management presence is advised. <br /> <br />Mrs. Thompson moved approval, and Mr. Ware seconded. <br /> <br />Mr. Schoomer said there have been a few complaints about housekeeping at this site, and perhaps the <br />City Manager could make it very clear to the operators that their efforts should be intensified to keep <br />the site neat and litter-free. <br /> <br />Responding to Mr. Wagner, Mr. Ollendorff said this restaurant/bar must derive at least 50% of its <br />revenue from non-liquor sales; if more than 50% is from liquor sales, it will lose its license. He said this <br />requirement is monitored regularly. <br /> <br />Mr. Lieberman questioned Mr. Ollendorffabout his statements regarding operation of the business, and <br />the City Manager said conditions may not be attached to a liquor license, however, he will strongly ad- <br />vise the operators that the site must be kept in an acceptable manner. <br /> <br />All voted Aye. <br /> <br />CONDITIONAL USE - 602 WESTGATE. SALEEM'S MARKET <br /> <br />The City Manager concurred in the Plan Commission's unanimous recommendation to approve a condi- <br />tional use permit for a carry-out restaurant with outdoor seating, subject to the following conditions: <br /> <br />1 <br />2. <br /> <br />Menu offerings shall be limited to deli-type items prepared at the store. <br />Outdoor dining shall be limited to a single row of tables placed on the sidewalk along the building <br />in an area approximately 26 feet in length, provided that permission is obtained in writing from the <br />owner of the building and the tenant in the adjacent portion of the building. <br /> <br /> <br />
