The operator of the restaurant shall regularly police the site and the area adjacent to the restaurant <br /> to remove litter and debris. <br />5. Trash containers for patron use shall be available on the premises at all times. <br /> <br />Mr. Schoomer moved approval, and Mr. Lieberman seconded <br /> <br />Responding to Mr. Wagner, Mr. Ollendorff said Council could approve a liquor license to sell by the <br />package only; however, a license by the drink includes package sales. <br /> <br />Mr. Lieberman noted that three of the five outdoor tables are in front of the adjacent business and the <br />Plan Commission wished to be sure the owner and tenant give permission to use that space. <br /> <br />Mr. Schoomer said the best restriction would be to limit the hours of package sales, or limit package <br />sales to Saleem's Restaurant across the street, as he did not want a walk-up liquor store. Mr. Wagner <br />agreed. Mr. Ollendorff said he would consult with the City Attorney to see if there was a way to limit <br />package sales ira license by the drink is approved, however, he noted the amount of floor space devoted <br />to alcohol sales may be limited. Mr. Wagner moved to table, pending obtaining answers to these con- <br />cems at the next meeting. Mr. Ware seconded. The roll call vote was as follows: AYES: Councilmem- <br />bers Ware, Wagner, Thompson, and Mayor Adams. NAYS: Councilmembers Munkel, Lieberman, and <br />Schoomer. The motion to table passed four to three <br /> <br />CONDITIONAL USE - 8202 DELMAR <br /> <br />The City Manager concurred in the Plan Commission recommendation that expansion of Agudas Israel <br />of St. Louis Synagogue be permitted into an adjacent space, with the following conditions: <br /> <br />1. The use shall be limited to spaces authorized by Conditional Use Permit #276 as amended. Any en- <br /> largement of the use or occupancy of additional spaces must first be reviewed by the Plan Commis- <br /> sion and approved by the City Council as a further amendment to this conditional use permit. <br />2. The exterior work on the front of the new addition and any revisions to the front entrance for the <br /> existing facility shall match the store front work on the existing facility, including the use of blinds <br /> or drapery on the windows. Remove existing sign box and lights lef~ by the former restaurant tenant <br /> and repaint area above storefront to match the balance of the synagogue storefront. This work shall <br /> be satisfactorily completed by September 3, 1996. <br />3. Repair blacktop surfaces, sealcoat and stripe the parking stalls. This work shall be satisfactorily <br /> completed by September 3, 1996. <br />4. Because of limited parking, the issuance of this permit is based on the use of the premises as an Or- <br /> thodox Jewish synagogue unless such use and the adequacy of the available off-street parking is re- <br /> viewed by the Plan Commission and approved by the City Council as a further amendment of this <br /> Conditional use permit. <br /> <br /> <br />
