Regular meeting <br />September 19, 2005 <br /> <br />suggested giving the developer a variance instead or changing the Ordinance. <br /> <br />Ms. Brot asked why this was not an issue before when it change ownerships several <br />times. <br /> <br />Mr. Ollendorff said that in 1998, there was a complete rewrite of the zoning ordinance <br />and this was the first time that this requirement came into being. No one could <br />remember why the acre restriction was included, as it was never a requirement before. <br />The Plan Commission is checking out every private school sites so they can create a list <br />of all the private schools and how many acres they have. Then the Plan Commission <br />and Council can act in October as to want they want to allow. <br /> <br />Mr. Wagner wanted to know if we could apply the Ordinance to just the one property. <br />Mr. Ollendorff said that he thought that this was the only property that would fall into this <br />category. The zoning ordinance has to apply to a class of properties and not a <br />particular property. <br /> <br />Mayor Adams said that a bill can always be introduced and Council can modify it later <br />after we receive all the facts. <br /> <br />Ms. Brot asked Mr. Ollendorff why this zoning was originally adopted because only this <br />lot has this requirement and it only concerns Private Schools. <br /> <br />Mr. Ollendorff said that this is still subject to review by the Plan Commission and he <br />would verify that this change would not affect another school. <br /> <br />Public Hearing was set for October 10 at 6:30 p.m. <br /> <br />Motion was carried unanimously. <br /> <br /> <br />AGENDA ITEM #8 – Request for Permit to Solicit – GrassRoots Machine <br />A representative was invited to attend the meeting. <br /> <br />Ms. Colquitt stated that she had previously asked to have a representative be present in <br />order to answer questions the Council may have. <br /> <br />Mayor Adams asked if the representative of GrassRoots Machine was present with no <br />response. <br /> <br />Ms. Colquitt said that since the Council had tabled this previously because Council had <br />questions to be addressed by a representative, that it should be tabled. <br /> <br />Ms. Brot agreed with Ms. Colquitt that a representative should have been present to <br />Page 6 <br /> <br />
