Regular meeting <br />September 19, 2005 <br /> <br />explain what their purpose is. <br /> <br />Mayor Adams also questioned whether the Loop Business District had been notified of <br />their request? Mr. Ollendorff did not think it was but the organization had all the correct <br />paperwork needed. <br /> <br />Ms. Colquitt motioned to table until a representative of the agency could appear at the <br />Council meeting and was seconded by Mr. Wagner. The motion carried unanimously. <br /> <br /> <br />AGENDA ITEM #9 – Site Plan – 7733 Olive <br />Site Plan was for expansion of Seafood City Market. It was tabled two sessions <br />previously at a City Council meeting pending explanation from owner on odor control <br />plus firm acceptance of all conditions Council spelled out. <br /> <br />Mr. Ollendorff explained that approving this bill would give the City more jurisdiction in <br />controlling odor than what was in existence. Offensive odors would violate the <br />Ordinance now if complaints are called in. If new site plan were approved, U-City could <br />fine them in two ways, violation of Site Plan, which has greater penalties, and also of <br />nuisance violation. <br /> <br />Ms. Colquitt motioned to table. Motion was defeated. <br /> <br />Mayor Adams asked if they had enough parking spaces required and Mr. Ollendorff <br />affirmed it. <br /> <br />Ms. Colquitt asked City Manager if anything had been done concerning the two <br />residents complaints about the odor at the last Council Meeting. Mr. Ollendorff said the <br />City did go out and check several times and were not able to detect any odors. Also in <br />checking with the police department to see if any complaints were issued, there were <br />none, so no violations were issued. <br /> <br />Mr. Lee Mak, the architect for Seafood City was present for questions. He talked to <br />owner about complaints of odor. Mr. Mak suggested that it be put in writing for owner to <br />sign explaining what would happen if he was found in violation. The architect also told <br />owner that he would need to have daily trash pick-up. <br /> <br />Ms. Colquitt had requested at previous Council Meeting for owner to talk with neighbors <br />and be able to report to the next Council Meeting. <br /> <br />Mr. Ollendorff did not recall this request, so meeting with neighbors did not happen. <br /> <br />Ms. Colquitt said that she did request this as she wanted businesses to be neighbor <br />friendly with our residents when we are bringing businesses into our community. <br />Page 7 <br /> <br />
