<br />Regular meeting <br />October 10, 2005 <br /> <br />Mayor Adams called for a voice vote which carried unanimously. <br /> <br />AGENDA ITEM #12 <br /> <br />Mr. Ollendorff had another Item to add to the Agenda presented to him by <br />Council member Brungardt. Mr. Brungardt requested discussion on public property and <br />its use for campaign material and legally regulated behavior of staff in election. <br /> <br />Mr. Ollendorff said that the specific issue of public property was photographs used in <br />campaign material and the second issue was the regulated behavior of staff in <br />elections. Mr. Ollendorff said that he was required to stay out of any discussions of <br />political issues. Therefore, Mr. Ollendorff had no comment of the first issue but on the <br />second issues he said that it was his duty to enforce City Laws and Rules prohibiting <br />Municipal Campaign involvement. Mr. Ollendorff supplied Council this night, three <br />relevant documents. First was the City Charter, of staff being prohibited. Second was <br />in the City Code, where a section described in detail the forms of political involvement in <br />local City elections that are prohibited to Municipal employees. Mr. Ollendorff said that <br />it is his job to enforce both the Charter and the Statute. Third, all employees work rules <br />for City staff and the appropriate work rule has been given to Council this night. This <br />spelled out that the City Manager would carried out disciplinary action of the City <br />employee violating work rule. This was Mr. Ollendorff's answer to the second question <br />and he was permitted to participate in the first one, the political issues. <br /> <br />Mr. Wagner motioned to add to the Agenda and was seconded by Ms. Brot. Motion <br />was carried unanimously. <br /> <br />Ms. Braungardt said she felt her reason for requesting this public discussion on this <br />political matter now was because candidates can use various mechanisms for building <br />their campaign and one of which are websites. Now there is the opportunity to display <br />photos on web-sites for candidates. One thing she wanted to discuss was that being an <br />incumbent would be to have the advantage of having a whole catalog of photographs <br />that was taken by the City staff. Ms. Brungardt stated that Public managed funds are <br />registered through the State and are accounted for through Ethics Commission. Ms. <br />Brungardt's question concerning Public funds and how it might relate to using City <br />produced photographs, on a candidate's website. She stated that last summer she had <br />some primitive concerns of what might go on at election time and had begun to write <br />what she had hoped would be some kind of Resolution to talk about it. Unfortunately <br />she never wrote it. Now coming to the point, Ms. Brungardt said that she received an <br />email about the Mayor's website displaying photographs that had to be produced and <br />provided by City staff. Ms. Brungardt wanted to know what kind of disclaimer is <br />required when items like photographs, that were produced and paid for with Public <br />funds, are used on a private campaign website.
