In the end the judge will decide <br />this. <br />Metro claimed that they would cancel any agreement they had with University City if the <br />City did not pass the proposed legislation. <br /> <br />Metro responded with what Mr. Wagner considered a threat that Metro would cancel <br />any agreement they had with University City. Mr. Wagner said that the council does not <br />take kindly to threats and would rather get together in a triangle negotiation. Mr. <br />Wagner said that before he made a motion to table this bill he would like for the Mayor <br />to open it for Public Comment. <br /> <br />LEGISLATIVE DOCKET <br />BILL NO. 8838 - RELATING TO THE CONSTRUCTION, ESTABLISHMENT <br />OPERATION AND MAINTENANCE OF THE CROSS COUNTY METROLlNK <br />SEGMENT I EXTENSION BY THE BI-STATE DEVELOPMENT AGENCY OF THE <br />MISSOURI-ILLINOIS METROPOLITAN DISTRICT ("METRO"), AND PROVIDING FOR <br />THE GRANT AND CONVEYANCE OF A RIGHT OF WAY FOR ROAD PURPOSES <br />AND PERMANENT EASEMENTS TO METRO UNDER, OVER OR ACROSS <br />PORTIONS OF THE FORMER RAILROAD RIGHT OF WAY ADJACENT TO <br />UNIVERSITY DRIVE ON THE NORTH AND TO THE FOREST PARK PARKWAY ON <br />THE SOUTH, BETWEEN THE WEST LINE OF MEHLVILLE AVENUE OF THE CITY <br />OF UNIVERSITY CITY AND THE EAST LINE OF BIG BEND BOULEVARD. <br /> <br />Public Comments: <br /> <br />Don Singer, 6963 Waterman <br />Issues were two Quit-Claim Deeds. For several years, Ames Place spent money <br />researching the ownership of this land and claiming damages against Metro. Two <br />weeks before the trial, City attorney, John Mulligan found a Quit Claim deed. Mr. Singer <br />said that by this bill Metro had made University City their advocate against Ames Place <br />and their law suit. He reminded the members of the Council that they have a duty to all <br />of the citizens of University City, not at the expense of Ames Place. Mr. Singer said the <br />seriousness of this condemnation suit could be an irreparable area if ever abandoned <br />again. Mr. Singer encouraged Council to defeat this bill and take a neutral stand. <br /> <br />Mr. Gentry Sayad, 6627 Pershing Ave. <br />Mr. Sayad identified himself as a partner in the firm of Armstrong, Teasdale. He said <br />the issue is the underlying litigation going on at this time and whether this Council <br />should take some action at this time for which you grant some easement or interest in <br />the property to a third party before the court has ruled on who has ownership. Mr. <br />Sayad said that it is one immature, two irresponsible and third, possibly illegal in the <br />sense of conveying an interest in property that University City doesn't even own. <br />Page 3 <br />
