Session 171 I, Minutes <br />November 24, 1997 <br /> <br />dealing with the subdivision ordinance, deals with the subdividing of land, whether <br />dividing a lot in half as a re-subdivision or dividing the land for residential or <br />industrial use. All of these cases would fall under the subdivision ordinance. In our <br />case, it was deemed that the current subdivision ordinance was woefully out of date, <br />measured against any type of standards. We sought to have a completely new <br />subdivision ordinance. <br /> <br />Mr. Charles Deutsch, #1 McKnight Place, said that over the past few years they have <br />been extremely successful in creating a very high level of occupancy in the <br />Gatesworth. As a result, they had been planning an expansion of it. During the last <br />year, they purchased an additional eight lots. They drew up a development plan and <br />called Mr. Hill, the zoning administrator, to make an appointment to submit the <br />plans. Mr. Hill told them that a new zoning ordinance was about to be passed. Mr. <br />Deutsch said that his plans were based on the old zoning ordinance and added one <br />hundred new parking spaces to the plan. The new zoning ordinance, as he <br />understands it, would require him to have one hundred ten to one hundred twenty <br />parking spaces, which would really compromise the green space or force the <br />addition of existing land, which they do not feel is necessary for good planning or <br />design. They also learned that the ordinance will only affect their new portion, and <br />that there was also a provision for a lesser number of parking if the additional <br />ground necessary was warehoused to provide the necessary parking within the plan. <br />This would be a very prohibitive obstacle. It was with great pain and expense that <br />they and the neighbors to the west reached an agreement on this assemblage. The <br />other neighbors adjoining them do not want to sell. He wanted to go on record <br />saying that they do not know everything that is involved in the new ordinance, and <br />Mr. Hill has been defining his understanding of how it will effect the project and <br />giving them updated information. Mr. Deutsch does not believe Mr. Hill or <br />themselves are fully aware of how the new ordinance will affect their plan. They did <br />submit their plan today under the old ordinance. <br /> <br />Mr. Lieberman asked Mr. Deutsch how many new parking places would be put into <br />the plan he just submitted. Mr. Deutsch responded that they had put into the plan <br />one hundred additional parking spaces for the fifty new units they would like to <br />build. <br /> <br />Mr. Wagner said that it was his understanding that Mr. Deutsch is reading and <br />interpreting the new ordinance under the category of multi-family dwellings and <br />what he is fearing is that the ordinance will lay on the requirements for all multi- <br />family residences. Mr. Deutsch replied that his first fear, while they have added one <br />hundred spaces in their proposed plan, is that it would require somewhat around <br />one hundred and twenty spaces.
