Mayor Adams <br />replied that it was a conditional use, but it did not mean that they would ever exist. <br />Mrs. Glickert asked why it should even be in the code at all. Mr. Goldman replied <br />that it would allow regulation of these types of stores, if and when Council decides <br />they would ever accept them in the future. Mayor Adams said that pawn shops were <br />in the code too, but that does not mean they will exist. Future Council groups may <br />decide to allow these types of businesses in the future and having them in the code, <br />now, would allow the City to regulate them. Mrs. Glickert could still not see the <br />purpose of even putting these in the code when it is a well known fact that we do not <br />want them. Mr. Schoomer said that if we have a conditional use, then we can review <br />any application for such an establishment. If we do not have a conditional use, then <br />such an establishment might be brought before Council disguised as something the <br />Council does permit and then we would not be able to regulate it. Mr. Goldman <br />gave Ms. Glickert an example: A liquor store is a retail sales establishment, unless <br />there is a specific provision in the code that prohibits packaged liquor stores, <br />someone could simply say they are applying for a retail store. They still would need <br />a license and they could be stopped at that point, but as far as zoning, they would be <br />permitted. By having it as a conditional use, they come before the Council, very <br />specifically, under a conditional use provision, if they are indeed granted a liquor <br />license by the City. <br /> <br />Responding to Mr. Lieberman, Mr. Goldman explained the new parking requirements <br />in an attempt to clarify why Mr. Deutsch's plan would still not have enough parking. <br />He explained that one requirement dealt with additional visitor parking, 6 spaces for <br />the first thirty units and an additional space for each twenty units additional. There is <br />an exception for elderly housing, that would allow, under conditional users, the ratio <br />to be dropped to three quarters of a space per unit, provided there is space on the <br />site for the full complement of parking should the project ever be converted from <br />housing for the elderly to conventional apartments. Mr. Deutsch would need <br />somewhere in the neighborhood of one hundred thirteen spaces. <br /> <br />Mayor Adams declared the public hearing closed. <br /> <br />AGENDA NO. 3 - PUBLIC HEARING - SUBDIVISION ORDINANCE: <br /> <br />Mayor Adams declared the Public Hearing open. <br /> <br />Being that there was no requests to speak, Mayor Adams declared the Public Hearing <br />closed. <br /> <br /> <br />
