Ms. Ricci <br />stated that this is why would be a good thing as this identifies these kinds of things as “out of <br />time” and “the way we have done things” and are not the proper process. Ms. Feier interjected <br />and asked Ms. Watson to explain to Ms. Ricci the law of why we have to do budget transfers <br />because we are required by law to do budget amendments, so it is not a legal issue and Ms. <br />Watson can explain the law to her. Ms. Ricci continued thanking the City Manager for some of <br />the information she requested but stated the two outstanding issues are still needed. The first <br />is the training of the City’s trash truck drivers as knowing that the citizens are now paying for <br />their carts and don’t want the drivers being the cause of any damage to them. Ms. Feier stated <br />she had forwarded information to the City Clerk after the meeting for distribution. The other <br />information she had requested was what was the advising of the consideration for safety and <br />what was vetted when the pond was installed at Ruth Park Golf Course? Ms. Feier stated that <br />they checked on it and found there were far more drownings in bathrooms, so additional study <br />was not required on it. Ms. Ricci stated she would await the formal response and Ms. Feier <br />stated that was the formal response. Ms. Ricci asked the City Manager from now on, when she <br />makes a request that Ms. Feier send her an email with that response. The City Manager stated <br />that it would go out in the weekly. Lastly Ms. Ricci stated she had asked for the pleadings in <br />current litigation. Mayor Adams interrupted stating that legal cannot be discussed in open <br />sessions. Ms. Ricci advised the Mayor, he misunderstood the distinction between personnel <br />and legal. If there is a suit it is a matter of public record already and to be discussed. <br />Otherwise, the current personnel matters should be discussed in closed session. She stated <br />that these legal matters are a matter of public record and all she is asking for is a copy of the <br />petition, the pleadings. She was not asking for any discussion on the dais. Ms. Ricci did think <br />that as a group the Council should have a discussion and should set a time for it. Ms. Ricci <br />asked Ms. Feier to get the Council some information on the long going issues that are <br />associated with 7231 Amherst. She stated that this is the third resident that has reported on- <br />going issues. <br /> <br />Ms. Feier asked Ms. Watson to come forward to explain the law to Ms. Ricci as she was <br />confused about budget transfers. <br /> <br />Ms. Watson responded to Ms. Feier’s request to explain the law to Ms. Ricci, stating the City <br />limits their budget transfers to what is needed at the end of the year. She stated that we are <br />required by law to have the City funds in balance, so if we spend more than appropriated the <br />budget transfer is needed or an amendment to additionally appropriate those funds according <br />to the State Statutes. Ms. Watson stated that it is very difficult to come to the Council for each <br />bill that comes in over budget. She stated that most cities do a mid-year transfer and an end of <br />year transfer, just to get things in order for year end. <br /> <br />Mr. Price started with a people number one item to the City Manager; the people that were <br />affected by the flood, the letter is still open ended. He asked if she could draft a letter to be <br />mailed to the congressional delegation. Secondly he asked the City Manager to have a method <br />of how people would sign. He asked this letter be mailed by November 15. Mr. Price stated <br />that there have been incidents of unruly behavior in the school system which has spilled over <br />into the neighborhood. He asked the City Clerk to find out when he had asked for a task force <br />on this issue. Mr. Price asked the Council for the second time that they initiate a task force <br />initiative with the school district to come up with a comprehensive plan. Mr. Price asked that <br />the two head administrators, the City Manager and the School Board Administrator get <br />something set up. He stated the other thing that Ms. Felton mentioned was about Olive Street <br />Road. He said he would not spend more time on the budget when there is no attention spent <br /> <br /> <br />
