Session 1710, Minutes <br />November 3, 1997 <br /> <br />Responding to Mr. Schoomer, Mr. Ollendorff said that this location was a <br />neighborhood tavern, called The Three of Us, which closed approximately two <br />years ago. <br /> <br />Mr. Anthony Montgomery, 1255 Ferguson, the applicant, said he was trying to <br />open a restaurant that would serve liquor, as well. The people in the area do not <br />have anywhere else to go. <br /> <br />Mr. Wagner asked about the nature of the operation. Mr. Montgomery replied that <br />it would be a restaurant/tavern. The restaurant would not be open 24 hours a day, <br />so the sports bar would come into play more after the food had stopped being <br />served. <br /> <br />Mr. Schoomer asked Mr. Montgomery if the Council's 6 month observation policy <br />was explained to him. Mr. Montgomery said that it was, but he was under the <br />impression that the previous business had only been closed for six months rather <br />than the longer period that Mr. Ollendorff had told him about. He was not aware <br />that the previous owners were operating under a false license. <br /> <br />Responding to Mr. Wagner, Mr. Montgomery explained that he had a parking lot <br />with twenty to twenty-five spaces and would not be using off street parking. <br /> <br />Mr. Lieberman asked Mr. Montgomery if the Council required him to operate as a <br />restaurant for six months first without liquor if it would create a hardship for him. <br />Mr. Montgomery said it would, only because he had intentions of opening up <br />without any license problems. He would, however, open up the restaurant, if <br />required to do so by the Council. <br /> <br />Mr. Schoomer moved denial of the application. Mr. Wagner seconded the motion. <br /> <br />Responding to Mr. Sharpe, Mayor Adams explained that it had been moved to deny <br />the applicant a liquor license at this time. He can reapply at the end of six months <br />for a liquor license without prejudice. <br /> <br />Mr. Wagner explained to Mr. Montgomery that the Council wishes to make sure <br />that he can establish a business that can survive as a restaurant, by itself, without <br />liquor. The Council does not encourage a bunch of bars in town by themselves. In <br />the past, it has been to the benefit of the business owner to operate as a restaurant <br />only, for six months. If this works, it sets a different tone for the business <br />differently than if it were to just to open up as a bar, in the first place. <br /> <br /> <br />
