An employee’s seniority shall terminate when that employee: <br />A) is terminated for cause, quits, or resigns; <br />B)fails to report for work at termination of authorized leave of absence without <br />just cause <br />C)has been laid off and upon recall fails to return to work within 14 days after <br />written notice of recall has been received by said employee; <br />D)is laid off for 36 continuous months; <br />E)is absent from work on unpaid leave of absence for reason of illness or injury <br />in accordance with Pension Ordinance provisions and Pension Board actions <br />and decisions. <br />Nothing in this section of the Memorandum shall restrict the Fire Department from terminating <br />the seniority of an employee when the employee has been dismissed for just cause. An <br />employee re-employed after termination of seniority, caused by the foregoing reasons, shall be <br />considered a new employee. <br />Article XIV: MANAGEMENT RIGHTS <br />The Union recognizes that any and all rights concerned with the management of the fire <br />Department and the direction of the working forces are exclusively that of the City except where <br />expressly and specifically modified, limited and restricted by the provisions of this <br />Memorandum. Such functions include, but are not limited to, the right to select and hire, to <br />assign work to employees, to promote to a better position, to suspend, to demote, to discipline, to <br />discharge for cause, to establish and maintain rules governing employee’s conduct and work, to <br />establish personal appearance standards, to determine the number of employees required in any <br />function or on any job, to relieve employees from duty because of lack of work, or for other <br />legitimate reasons, the right to set work schedule or to change schedules already set, the right to <br />study, determine and regulate the methods, quantity, quality and type of work, the right to <br />control overtime and the necessity of employees working overtime, the right to determine the <br />number, location, and types of its facilities and operations, the right to determine the extent to <br />which any operation or part or all of its operation or move the same, the right to change methods <br />or procedures or to use any equipment, the right to change or introduce new or improved <br />equipment, procedures, or facilities, and the right to determine the methods and means of <br />operation. <br />Article XV: GRIEVANCE PROCEDURE <br />A grievance is a difference between the Union or an individual employee member of <br />Local 2665 and the City regarding the interpretation and/or the application of this Memorandum <br />or regarding disciplinary action taken by the Department against an employee member. The <br />procedural steps for the handling of grievances by the Department Supervisors, the Fire Chief <br />and the employees shall conform to the substance of Rule 13 of the Civil Service rules of <br />University City. <br />7 <br /> <br />
