Session 1733, Minutes <br />October 12, 1998 <br /> <br />been generated as of yet to the state, which will not occur until the end of the fiscal <br />year. Mr. Munkel asked Mr. Rose who the officers of the corporation were. Mr. Rose <br />said that there is a listing, but that he did not have the list readily available at this time. <br /> <br />Mr. Lieberman understood that the liquor license process was completed. Mr. <br />Ollendorff said that was correct and that everything was in order as far as complying <br />with city ordinances and City Council policy. The liquor license was approved with the <br />understanding that the applicant would follow through with the conditional use permit, <br />which they have now done. Mr. Lieberman asked if there was a sense of the Council in <br />regards to putting the condition on the permit requiring that patrons of the restaurant <br />and lounge be age 30 or above. The Mayor had not heard of any suggestions by <br />Council that this requirement be added as a condition. Mr. Lieberman said that if this <br />requirement is no~. added as a condition, then the applicant is not obligated to do it, no <br />matter what was said. The Mayor responded that he was correct. Mr. Lieberman is <br />also concerned that any future sale of the business should not include an automatic <br />transfer of the liquor license. He believes that it must come back before Council and if <br />necessary should be made one of the conditions. Mr. Munkel agrees with Mr. <br />Lieberman. Mr. Ollendorff believes that Mr. Lieberman is right. The ordinance requires <br />that if there is a new owner, then it has to come back before the City Council. If it is <br />strictly a name change or a basic continuation of the same company, then it does not <br />legally have to come back to Council. A change in ownership requires that it comes <br />back. Mr. Lieberrr,an asked what this means within a corporation, when there are <br />several names and one of the members changes. Mr. Ollendorff replied that if it was a <br />new corporation, then it would have to come before Council. Mr. Ollendorff used an <br />example of the 7-Eleven store franchisees. Mr. Ollendorff said that Mr. Lieberman's <br />question was a good one, however, and he would refer it to the city attorney for review. <br /> <br />James Whitney, 8000 Bonhomme, 63105 is attorney for Lisa Reed owner of 7555 <br />Olive. Mr. Whitney explained the steps that he and Ms. Reed have taken, and will take <br />in the future, in complying with the conditional use permit. Mr. Whitney explained to Mr. <br />Munkel that the corporation papers would not be in existence until January 1999. <br /> <br />The motion carried unanimously to approve the conditional use permit. <br /> <br />AGENDA NO. 3 - COUNCIL POLICY ON BOARDS AND COMMISSIONS: <br /> <br />Mr. Ollendorff said that he understood that the Council had a new policy on Boards and <br />Commissions. Action can be taken for adoption at Council's discretion. <br /> <br />Mr. Munkel moved adoption. Mr. Lieberman seconded the motion, which carried <br />unanimously. <br /> <br /> <br />
