<br />Forest Park through Washington University campus and completed on Ackert Walkway at <br />Vernon. The second would complete a section of trail from Shaw Park to Olive Blvd. The <br />agreement needed to be the same for Great Rivers Greenway, Olivette and University City. <br />Ms. Feier suggested that unless there are substantial changes to leave the agreement as is <br />to avoid getting new signatures from Olivette and the Great Rivers Greenway. Ms. Feier <br />stated the Parks department felt comfortable with maintaining the trail. <br /> <br />Mr. Wagner moved for approval and was seconded by Mr. Sharpe. <br /> <br />Ms. Ricci stated as she expressed in the study session that she wants the greenway to <br />proceed forward but had concerns about the two agreements. First she noted that “the <br />maintenance should begin after the completion of the trail by the Great Rivers Greenway” <br />be added Ms. Ricci also noted in the agreement with Olivette that there was no cost <br />agreement in the contracts when U City is doing work in Olivette when it should be border <br />specific. She also said that it appears that Olivette is using a different term, “Capital <br />improvement to facilities: in describing the same thing. Ms. Ricci noted she was advised the <br />facilities and the trails are the same and thought the same terminology should be consistent. <br /> <br />Ms. MacCartney said she would answer it in two parts. The section from Kingsbury to 400 <br />feet north of Delmar is essentially a widening of the sidewalk to make it trail standard. She <br />noted the City is already maintaining that area. Ms. MacCartney said she did not anticipate <br />any extra cost associated with that. She said the second section just north of Schnucks at <br />I170 that crosses over Delmar up McKnight will be constructed in concrete. Ms. <br />MacCartney said MoDOT will be doing the mowing in this corridor as it is their right-of-way. <br />She said that because of the construction type she did not anticipate it to take more than a <br />couple hours a month to maintain it. Ms. MacCartney thought it would be easier for U City <br />to go another couple hundred feet in maintaining the trail. <br /> <br />Ms. Ricci asked if there would be an issue if someone was injured on the Olivette 200 feet <br />portion due to neglect of U City’s maintenance. She asked who would be liable as the <br />agreement was not clear. Ms. MacCartney said that Olivette would be responsible for any <br />capital improvement north of structure to Olive Blvd. University City would have agreed as it <br />seemed to make sense to maintain the section all the way to Olive Blvd. She said the direct <br />route has not been designated and Ms. MacCartney said that all of the trail could end up in <br />University City. She said this agreement had to be in place prior to the final design which <br />would show the final route. Ms. Ricci stated that this agreement is not doing what Ms. <br />MacCartney is telling them. <br /> <br />The agreement was approved with one Nay vote from Ms. Ricci. <br /> <br />J.
