Because the total amount <br />of legal fees was less than the $10,000 a counter claim against Mr. Henreid <br />would likely not prove advantageous. CALOP funds have covered the legal <br />expense up to this point. <br /> <br />University City insurance defense counsel Peter Dunne notified me that the six <br />U- City officials named--Mayor Joseph Adams; Police Chief Charles Adams; <br />Police Officers Thomas Carney, Terrence Lott, and William Linenweber and John <br />lawsuit <br />Mulligan in the lawsuit. The basically alleges that Cedric Turner was <br />falsely accused and arrested for possessing and attempting to make a purchase <br />with counterfeit currency at the Walgreens store at 7501 Olive. It is my <br />understanding that Mr. Turner was detained for nearly an hour during a <br />counterfeit currency report investigation, but he was released after it was <br />determined by Walgreens that the currency was not counterfeit. The First <br />Amended Petition, which was recently filed, alleges in Count V that Mayor <br />Adams, Chief Adams, and the City Attorney "are responsible for the <br />administration of the City of University City Police Department in a fair, legal and <br />even handed manner, free of any racial bias, discriminatory treatment by its <br />officers, and illegal practices and or practices." Mr. Turner seeks an injunction <br />"compelling [us] to allow [him] to be free of any discriminatory and or negligent <br />treatment by Defendants." In other counts, Mr. Turner seeks $100,000 in <br />compensatory damages, $20,000 for attorney's fees, and punitive damages in an <br />unspecified amount, against the Defendants. There is no indication that this claim <br />holds any merit and should be dismissed on appeal. <br /> <br />Metro's appeal of Judge Vincent's March 15, 2006 Order and Judgment on the <br />Green Space has been set for trial September 5, 2006. As you may recall, Judge <br />Vincent ruled that Ames Place Subdivision is the owner of the Green Space and <br />MetroLink <br />is entitled to damages for the taking associated with the construction <br />project. Metro's attorney said the appeal is pending and will not be decided <br />before the trial date. She indicated that she will need Park Maintenance <br />Supervisor Ewald Winker and possibly Zoning Administrator Frank Hill to testify <br />at the trial. Mr. Mulligan and she discussed possible interest in an agreement to <br />resolve any outstanding issues between University City and Metro with respect to <br />existing easements, as well as University City's support of Metro's position in the <br />Green Space litigation. Mr. Mulligan informed her that he would first check with <br />me on the outstanding issues. It is my understanding that Council does not wish <br />to join Metro against Ames Place and therefore we will not participate in the <br />negotiation on the remaining items. <br /> <br />annual auction <br />The University City Police Department will hold the of unclaimed <br />property on Saturday August 26, 2006 at 11:00 A.M. on the Police Department <br />parking lot. In case of rain, the auction will be held inside Engine House #1. <br />We will have various items to auction which will include bicycles, jewelry, office <br />chairs, electronic equipment, and more. <br /> <br />
