Session 1708, Minutes October 13, 1997 Mr. Ollendorff clarified Mr. Schoomer's motion saying that it did not include the twenty-five foot rear setback, which he suggested, but does include the six conditions as specified by Mr. Goldman and a twenty foot rear setback. Mr. Schoomer said that this was correct. Mayor Adams asked that a condition be added that stated that there would be no greater than three bedrooms in this project. Mr. Sharpe, being newly appointed, wanted to let the audience know that he drove by the site and looked carefully at it, before he attempted to vote on it. Mr. Schoomer said that even though he did not meet, personally, with the residents on Donne, he had made at least five trips to the site and to Donne, during the course of these deliberations. Mayor Adams ordered a roll call vote for this question. AYES: Mr. Munkel, Mr. Lieberman, Mr. Schoomer, Mr. Sharpe, Mayor Adams. NAY: Mr. Wagner. The motion passed 5 to 1. AGENDA NO. 6 - CONDITIONAL USE PERMIT - 7700 DELMAR: Mr. Ollendorff recommends approval of a conditional use permit for a wonderful food service facility at 7700 Delmar. Approval is recommended by the Plan Commission with several conditions: The development must conform with our sign code, they must submit an acceptable plan for deliveries and refuse storage, odor controls must be installed to prevent the exhausting of any odors beyond the restaurant property lines, no outdoor dining without specific approval of such a plan, operating hours be limited from seven a.m. to nine p.m., that this property and the neighboring properties be patrolled regularly for litter and that supplies be delivered only during daylight hours. With these conditions, Mr. Ollendorff believes that this business would be a good asset to our community. Mr. Munkel moved approval of the conditional use permit with conditions. Mr. Sharpe seconded the motion. Helen Fletcher, 7467 Kingsbury, responding to Mr. Lieberman, is aware and agrees to all of the conditions as stated by the City Manager. She understands and will adhere to all conditions. The all-aye motion carried unanimously.
