Session 1708, Minutes <br />October 13, 1997 <br /> <br />Mr. Ollendorff clarified Mr. Schoomer's motion saying that it did not include the <br />twenty-five foot rear setback, which he suggested, but does include the six <br />conditions as specified by Mr. Goldman and a twenty foot rear setback. Mr. <br />Schoomer said that this was correct. <br /> <br />Mayor Adams asked that a condition be added that stated that there would be no <br />greater than three bedrooms in this project. <br /> <br />Mr. Sharpe, being newly appointed, wanted to let the audience know that he drove <br />by the site and looked carefully at it, before he attempted to vote on it. <br /> <br />Mr. Schoomer said that even though he did not meet, personally, with the residents <br />on Donne, he had made at least five trips to the site and to Donne, during the <br />course of these deliberations. <br /> <br />Mayor Adams ordered a roll call vote for this question. AYES: Mr. Munkel, Mr. <br />Lieberman, Mr. Schoomer, Mr. Sharpe, Mayor Adams. NAY: Mr. Wagner. The <br />motion passed 5 to 1. <br /> <br />AGENDA NO. 6 - CONDITIONAL USE PERMIT - 7700 DELMAR: <br /> <br />Mr. Ollendorff recommends approval of a conditional use permit for a wonderful <br />food service facility at 7700 Delmar. Approval is recommended by the Plan <br />Commission with several conditions: The development must conform with our sign <br />code, they must submit an acceptable plan for deliveries and refuse storage, odor <br />controls must be installed to prevent the exhausting of any odors beyond the <br />restaurant property lines, no outdoor dining without specific approval of such a <br />plan, operating hours be limited from seven a.m. to nine p.m., that this property <br />and the neighboring properties be patrolled regularly for litter and that supplies be <br />delivered only during daylight hours. With these conditions, Mr. Ollendorff believes <br />that this business would be a good asset to our community. <br /> <br />Mr. Munkel moved approval of the conditional use permit with conditions. Mr. <br />Sharpe seconded the motion. <br /> <br />Helen Fletcher, 7467 Kingsbury, responding to Mr. Lieberman, is aware and agrees <br />to all of the conditions as stated by the City Manager. She understands and will <br />adhere to all conditions. <br /> <br />The all-aye motion carried unanimously. <br /> <br /> <br />
