<br /> <br /> <br /> <br /> Session 1318, Minutes Page 7 <br /> November 8, 1982 <br /> <br /> REPORT ON LAWSUIT FROM COUNCILMEMBER LIEBERMAN <br /> <br /> Mr. Lieberman said the Executive Board of the St. Louis County Municipal League met <br /> just prior to this meeting, and among the items considered was a lawsuit filed <br /> against the cities of Frontenac and University City in connection with the Hancock <br /> Amendment. He said the Executive Board decided to take action on this matter by <br /> asking the League staff to prepare a position statement in support of University <br /> City and Frontenac, which will be considered by the League membership at its Novem- <br /> ber 18 meeting. The Board also voted unanimously to pay one-third of the cost (up <br /> to a maximum of $1500) of special counsel for the two cities during the Circuit and <br /> Appellate Court stages of action. In addition, the Board discussed whether or not <br /> to enter into an amicus curiae brief, but held that decision in abeyance until the <br /> next Board meeting in January, 1983. Mr. Lieberman urged the Council to attend the <br /> November 18 meeting at the Clayton Community Center. <br /> Mr. Adams said this issue was also discussed by the Missouri Municipal League Board <br /> of Directors, who were very concerned and supportive of Frontenac and University <br /> City. He said the Board would like to know officially if the cities would like the <br /> Board to take part in this litigation. Mayor Mooney said a letter would be pre- <br /> pared asking the Board for their support. <br /> Mr. Lieberman pointed out that the City Council had really not acted on this matter <br /> and suggested that a resolution stating the Council's position should be prepared <br /> and approved at the next Council meeting. It was agreed this would be done. <br /> Mr. Ollendorff thanked Mr. Lieberman for the good news and for being instrumental <br /> in obtaining it. <br /> BILL FOR SECOND READING <br /> <br /> BILL NO. 7554 - AMENDING CHAPTER 34 MUNICIPAL CODE RELATING TO ZONING BY REPEALING <br /> SECTION 34-40, AND ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION 34-40 'PA' <br /> PUBLIC ACTIVITY DISTRICT,"CHANGING THE NUMBERING AND ADDING BUSINESS, PROFESSIONAL, <br /> MEDICAL OR INSTITUTIONAL OFFICES AS A CONDITIONAL USE. <br /> Bill No. 7554 was given its second reading. <br /> <br /> Bill No. 7554 was given its third reading. <br /> Mr. Adams moved that this bill be adopted as an ordinance. Mr. Schoomer seconded <br /> the motion. Upon roll call, the following vote was recorded: AYES: Councilmem- <br /> bers Adams, Metcalfe, Levy, Schoomer, Thompson, Lieberman and Mayor Mooney. NAYS: <br /> None. Bill No. 7554 became Ordinance No. 5350. <br /> BILL FOR INTRODUCTION <br /> <br /> BILL NO. 7555 - VACATING AND SURRENDERING THE RIGHT-OF-WAY OF A PORTION OF APPLETON <br /> _ DRIVE AND BRADDOCK DRIVE IN DARSTDALE AND DARSTDALE #2 SUBDIVISIONS, BUT RESERVING <br /> PUBLIC UTILITY EASEMENTS. <br /> A bill was introduced by Councilmember Schoomer, entitled: <br /> <br /> "AN ORDINANCE VACATING AND SURRENDERING THE RIGHT-OF-WAY OF A PORTION OF APPLETON <br /> DRIVE AND BRADDOCK DRIVE IN DARSTDALE AND DARSTDALE #2 SUBDIVISIONS, BUT RESERVING <br />
