i f <br /> <br /> <br /> <br /> Session 1317, Minutes Page 3 <br /> October 25, 1982 <br /> I <br /> Responding to Mrs. Metcalfe, Mr. Ross said his St. Louis store closed at 7:30 p.m. <br /> and the University City store closed at 11:30 p.m. He said the St. Louis store was <br /> in a very tough neighborhood. Mrs. Metcalfe said that as far as she was concerned, <br /> the main issue was that of staying open so late, pointing out that large grocery <br /> stores that sell beer close relatively early. <br /> Mr. Adams recalled that the Council. had, in fact, denied liquor licenses to large <br /> operations. He asked Mr. Ross if he had considered closing earlier. Mr. Ross said <br /> many people get off work at 11:00 p.m. and have said they would patronize his store <br /> if he was open at that hour. <br /> <br /> Mrs. Metcalfe said the Council lacked some information, namely the petition just <br /> discussed, and thought perhaps the matter should be postponed again. She emphasized <br /> there was no question about the character of Mr. Ross, but said the Council must <br /> consider whether or not it was desirable to have late-night places which sold pack- <br /> age liquor (and to consider what problems may be created by this activity), and that <br /> although the area was zoned GC (General Commercial), it was adjacent to a residen- <br /> tial area where late-night activity generated by the sale of beer may intrude on the <br /> neighborhood. The issue of a proliferation of liquor licenses in a particular area <br /> also must be considered. <br /> Mr. Schoomer said he also would appreciate an opportunity to inspect the petition, <br /> and he moved postponement. Mrs. Metcalfe seconded the motion, which carried unani- <br /> mously. <br /> PUBLIC HEARING - ZONING ORDINANCE AMENDMENT <br /> <br /> The City Manager said a public hearing was scheduled for 8:00 p.m. to hear and con- <br /> sider comments concerning a proposed amendment to the Zoning Code which would allow <br /> buildings in a "PA" Public Activity district to be used for business, professional, <br /> medical or institutional offices subject to a conditional use permit approved by <br /> the City Council. The objective of the amendment was to obtain a high level of con- <br /> trol over such uses when and if the Plan Commission and City Council approve a spe- <br /> cific proposal. The alternative to the amendment would be to rezone any properties <br /> being considered for such use, giving the Council much less control over future uses <br /> of the property. The amendment was unanimously recommended by the Plan Commission <br /> and supported by the Planning staff. <br /> Mayor Mooney opened the public hearing at 8:01 p.m. <br /> Mr. John F. O'Leary, 6950 Washington, asked to address the Council. He said that <br /> a building which would be affected by the proposed change was in his subdivision, <br /> and as trustee, he was trying to ascertain what powers were available to the sub- <br /> division in regard to this matter: He was concerned that too many groups might oc- <br /> cupy this building, adding to already-existing traffic problems. <br /> Mrs. Metcalfe said the procedure was that an applicant would go before the Plan <br /> Commission, which would review tha application and hold a public hearing. If they <br /> approve, the application would then come before the Council for their review. The <br /> Council may attach whatever conditions or restrictions it felt were necessary to <br /> the approval. She noted that Mr. O'Leary had raised the question of whether or not <br /> Council approval of a conditional use permit would apply only to the building or to <br />
