<br /> <br /> <br /> <br /> Session 1309, Minutes Page 3 <br /> June 7, 1982 <br /> <br /> <br /> In response to Mr. Levy's question concerning items which did not comply with the <br /> code, Mr. Ollendorff said there was a list of about 50 small items which did not <br /> comply with the minimum code. Even if all of those items were corrected, however, <br /> he did not feel the property would be up to what he considered a good standard. <br /> Mr. Michael Forst, 4 South Euclid, the attorney representing the owner, Mrs. Ethel <br /> Hicks, asked to address the Council. Mr. Forst said Mrs. Hicks would comply with <br /> the code by abating the listed violations, although she told him she had not re- <br /> ceived a copy of those violations. <br /> Mrs. Thompson said she would like to see a time limit of perhaps two months set for <br /> compliance with the code violations. <br /> <br /> Mr. Lieberman asked if the condominium conversion was based on retaining the base- <br /> ment apartment. Mr. Forst said he was told by Mr. Goldman, Director of Planning, <br /> that the basement apartment was not illegal, and if that was correct, it would be <br /> used partly as a common area and as a residence for the building's maintenance per- <br /> son. Mr, Lieberman said the Council had received information contradictory to that <br /> furnished by Mr. Forst, and he thought this matter should be postponed before any <br /> action was taken. <br /> Mr. Ollendorff said that although a basement apartment, per se, is not illegal, <br /> this one is because of various conditions (height of ceiling, etc.), although it <br /> was possible it could be made legal. <br /> Mr. Adams asked if he understood correctly that nothing beyond that required by the <br /> code would be done to the apartments, and Mr. Forst said that was correct, that <br /> there would be no cosmetic improvements since it was felt that the building has <br /> been well-maintained. <br /> Mrs. Metcalfe asked the date of the inspection, and Mr. 0llendorff said it was May <br /> 14th. Mrs. Metcalfe said it should not take so long to get the results of the in- <br /> spection to the owner. She moved to table the matter. Mr. Adams seconded the mo- <br /> tion, which carried unanimously. <br /> <br /> Mr. Schoomer asked that the documentation on this item be provided to the Council-- <br /> the inspection report, the plat, condominium by-laws and conversion documents. <br /> (Additional comments by Mr. Ollendorff on this matter appear later in these minutes.) <br /> <br /> **At this point, Mr. Kay left the meeting. <br /> <br /> CONDITIONAL USE PERMIT - 7039 WASHINGTON <br /> The City Manager said an application had been received for use of a private swimming <br /> pool in a residential zone for a swimming program for the Childgrove School Summer <br /> Camp. He said the intensity of such use was generally considered incompatible with <br /> the nature of a residential neighborhood and is, therefore, only possible under a <br /> conditional use permit, Following detailed consideration of all points of view, <br /> the Plan Commission recommended approval with very stringent conditions. It fur- <br /> thur recommended that such approval be granted only through August 30, 1982. Mr. <br /> Ollendorff said he would concur with the Plan Commission recommendation only if it <br />
