was concerned if members would not be as familiar with youth activity now rather than <br />when member was a youth. <br /> <br />Mayor Welsch noted that once social workers are on board to help the committee they <br />could determine to split up the groups early on. She would suggest that <br />Councilmember would remember when appointing to pick one that would be good for <br />Senior representation and one for Youth representation. <br /> <br /> <br /> Mayor Welsch will be looking to re-establish the Commission on Human Relations. <br />In researching it, she found that it was set up in 1960 and the City Clerk could not find <br />any appointments to this commission after 1991. Mayor Welsch distributed the <br />ordinance which established the commission. She said at the September 20 Council <br />meeting a new revised ordinance will be introduced to re-establish this commission <br />and new appointments will be made. <br /> <br />L. UNFINISHED BUSINESS <br />BILLS <br />1. <br />BILL 9084 - An ordinance approving a settlement agreement with T-Mobile. <br /> <br />Mr. Glickert moved Bill 9084 for approval and was seconded by Mr. Price. <br /> <br />City Manager Lehman Walker suggested an amendment be made to this bill. The <br />amendment to be added in Section 2, to clarify that the City of University City does not take <br />a position on the disposition of attorney fees. <br />“Section Two: The City of University City, Missouri further approves the relief <br />provided in the Settlement Agreement, as adequate consideration for the release <br />of claims by the City of University City, Missouri against T-Mobile as provided fro <br />in the Settlement Agreement. The City of University City, Missouri takes no <br />position on the payment of attorneys’ fees, costs, or expenses which subject, as <br />provided for in Settlement Agreement, will rather be taken up and considered <br />separately by the Court.” <br /> <br />Mr. Walker advised the Council that the City did file for an extension of time in order for the <br />City to review it and stated that this would not affect in any way the payment to the City. <br /> <br />Mr. Kraft moved to accept amendment as read per Section Two and was seconded by Mr. <br />Sharpe. <br /> <br />Ms. Ricci advised Council that her brother-in-law was listed as counsel for the defendant T- <br />Mobile and wanted to disclose this. <br /> <br />Mr. Price asked for clarification of meaning of “further approves the relief” and later says <br />“release of claims of the settlement.” <br /> <br />Mr. Walker said that it essentially means that the City is not going to take a position on the <br />payment of the fees. He said on October 19, 2010, the court will be reviewing the legal <br />fees. <br /> <br />City attorney John Mulligan stated that on October 19 the court will have a final fairness <br />hearing in respect to the settlement and in aspect to fairness of attorney fees.
