Session 1746 <br />February 8, 1999 <br /> <br />pointed out that the assessments will become a debt against these properties as soon as <br />the resolution is passed. It will provide greater security if each one of these bills are <br />recorded against each one of these properties. It will be fifteen dollars each to record bills <br />for two hundred sixty properties, which would total over $4,000. Typically, these types of <br />assessments have not been recorded in the past. The city, generally, depends on title <br />companies to catch the debts when a property sells. Third, there are six properties that <br />front on Delmar that are part of the subdivision, which were included in the petition to set <br />up the neighborhood improvement district. These six properties, do not get any <br />improvement, with this project. Delmar is a county road. These six property owners <br />appeal to Council ro reduce their assessments. Councilmember Schoomer said that these <br />six property owners would pay 10% of the normal amount. <br /> <br />Mr. Schoomer made a motion to go with the sixty day payment without interest, to not <br />record the bills as liens against the properties, and to approve the 10% reduced <br />assessment fee to the six Delmar property owners. Mr. Munkel seconded the motion. <br /> <br />Mr. Wagner asked if the recording of the liens had to be done immediately. Mr. Ollendorff <br />said that the recorcling should not be done until after the sixty day period. Mr. Wagner <br />agrees with Mr. Schoomer's motion, however, he believes that any assessments not paid <br />after the sixty day period should be recorded. <br /> <br />Ms. Colquitt agrees with Mr. Schoomer's motion, yet she believes that liens should be <br />placed against the properties, instead of relying on the title companies. <br /> <br />Mr. Schoomer believed that there is a statute of limitation of five years to record a lien. Mr. <br />Ollendorff did not know. <br /> <br />Responding to Mayor Adams, Mr. Ollendorff said that the timing of when to file the liens <br />can come later, but what had to be decided tonight was the amount of money that would <br />have to be added to the total improvement cost. <br /> <br />Discussion ensued regarding whether or not it would be necessary to file liens and if liens <br />were filed, how long should the city wait before they were to be filed. <br /> <br />Mr. Wagner moved to amend the main motion by Mr. Schoomer to go with the sixty day <br />payment without interest, to record the bills as liens against the properties after twelve <br />months, and to approve the 10% reduced assessment fee to the six Delmar property <br />owners. Ms. Colquitt seconded the motion. The motion carried, except for Mr. Schoomer <br />and Mr. Munkel who voted Nay. The motion passed 5 to 2. <br /> <br /> <br />
