Session 1736, Minutes 6 <br />December 7, 1998 <br /> <br />Mr. Wagner asked for clarifications of the other points that needed further negotiation. <br />Mr. Rose stated that the extension to 2000 was one point, the other was the details of <br />the construction of the institutional network and the emergency alert override system. <br />Some of the issues for the extension involve the experience level of AT&T in never <br />operating a cable .company before, TCI's plans to upgrade the system. The community <br />needs an opportunity to define other needs. <br /> <br />Mr. Sharpe asked for clarification of the recommended action requested of Council. Mr. <br />Rose said that the request was to extend the franchise to December 23, 2000. <br /> <br />Mr. Schoomer required further clarification. Mr. Rose responded that TCI is requesting <br />a thirty day extension to January 27, 1999. Council would have until this date to act on <br />it. <br /> <br />Mr. Berra said that the extension request was on TCI letterhead and signed by himself. <br />Mr. Kiping, being with AT&T, would verify that they have executed many franchise <br />transfers where he, Mr. Berra, has signed on behalf of both parties. <br /> <br />The Mayor summarized Council's option again: 1) approval of the ordinance as <br />submitted, which goes out to the year 2000, 2) amend the ordinance to go to either <br />June 23, 2000 or December 23, 2000; 3) give the City and the franchise a thirty day <br />extension in order [o work out the differences between the two parties. <br /> <br />Mr. Schoomer moved approval of the thirty day extension. Mr. Sharpe seconded the <br />motion. <br /> <br />Mr. Munkel said that he was not opposed to the extension, because it gives both parties <br />time to work out their differences. At that point, we will need to decide whether or not to <br />go to choice 1 or 2. Mayor said that a third option may be offered depending on what <br />both parties decide. on. <br /> <br />Mr. Wagner said that he would prefer wording that we agree to the thirty day extension, <br />pending approval and that the city would still have the option to act before January 7th <br />with an emergency meeting to do something else. The Mayor said that it would be in <br />the minutes that both TCI and AT&T had asked for the extension. The City has to <br />approve it or reject it. <br /> <br />The motion carried unanimously. <br /> <br /> <br />
