NEW BUSINESS <br />RESOLUTIONS <br />1. <br />Resolution 2011 – 6 A resolution delegating a certain level of budget transfer authority to <br />the City <br />Mr. Sharpe moved to approve and was seconded by Mr. Kraft. <br /> <br />Ms. Ricci said this is the resolution that provides the City Manager with transfer authority. <br />She said, with no reflection on City Manager as she has great faith in his decision making, <br />but again her budget transfer questions remained unanswered. Ms. Ricci believes that this <br />is an authority that the Council cannot delegate. <br /> <br />Mr. Price said Ms. Ricci stated what he would have said and he did not think the Council <br />should delegate that authority. <br /> <br />Mayor Welsch asked Mr. Walker if he could clarify if this resolution is approving an authority <br />that has been approved for the past several years. <br /> <br />Mr. Walker said initially this resolution was brought to Council in 2008 and essentially <br />provides the City Manager to have budget transfer authority up to $25,000. He felt that <br />some level of authority, the amount could differ, was absolutely necessary for the City to <br />function. If not the City Manager would have to come to Council for approval of items minor <br />in nature. <br /> <br />CITIZEN COMMENTS <br />Paulette Carr, 7901 Gannon <br />Ms. Carr said she was pleased that Ms. Ricci has remained consistent on this issue. She <br />had a handout and requested it be attached to the minutes which Ms. Ricci put on record at <br />the March 22, 2010 meeting which stated “Council is delegating a non-delegable duty to the <br />City Manager to transfer up to $25,000 per line item without Council approval. This is <br />illegal. City Manager individually and through the Finance Director has the ability to spend <br />hundreds of thousands of dollars and after the fact seek Council ratification. This goes to <br />the heart of Council responsibility for oversight and accountability.” Ms. Carr agreed with <br />Ms. Ricci and Mr. Price when you abdicate your responsibility as a Councilmember, the City <br />Manager cannot be blamed for usurping your power. She said the Council is responsible to <br />oversee large expenditures. <br /> <br />Mr. Sharpe asked the City Manager would consult the City Attorney to inform the Council if <br />this was a legal or illegal concept under consideration. <br /> <br /> <br /> 5 <br /> <br />
