<br />. <br /> <br />. <br /> <br />Minutes-Plan Commission <br />Page 2 <br />May 28, 1986 <br /> <br />husband planned no structural changes for the building at 7515 Delmar other than a <br />small sign for an already interested tenant, a small investment firm. She felt that <br />the firm would be a high-quality tenant for a quiet, compatible commercial use. <br /> <br />Chairman Hamilton asked Mr. Goldman to respond to the applicant's request. Mr. <br />Goldman stated that the zoning history along Delmar had been such that it had <br />prevented encroachment of commercial uses into existing residential zones. Therefore, <br />"LC" districts have been confined to what had been existing service commercial uses at <br />or near the corners of Delmar and Hanley and Delmar and North and South. He stated <br />that the lot at 7515 Delmar did not meet the minimum lot size standards for the "LC" <br />District and that this would be a factor when an isolated lot becomes part of a <br />commercial district. He felt that the parking problem was a self-imposed one. The <br />Bendases were aware of the parking shortage. The decision by the Board of Adjustment <br />granting front-yard parking in 1978 had been a liberal one. He recommended that the <br />Bendases, as new owners of the adjoining property pursue an easement in favor of the <br />property at 7505 Delmar and keep the property at 7515 Delmar as residential. <br /> <br />Mr. Rice questioned the Bendases on their statement that the Sun Oil Company which <br />operates a station immediately to the east of their business, would not negotiate an <br />easement in favor of 7515 Delmar. Mr. Bendas stated that the Sun Oil Company had sold <br />that property to Southland Corp., but that Sun Oil had never been willing to grant <br />them an easement. Mr. McCauley asked if there was currently a driveway to the rear of <br />the property on the east side of 7515 Delmar. He ascertained from Mr. Goldman that <br />7505 Delmar could benefit from rear yard parking without any zoning change at all, but <br />that 7515 Delmar's backyard could not be used for commercial parking without a zoning <br />change. Mr. Bendas replied that there was currently a driveway at 7515 Delmar on the <br />east side of the lot. Mrs. Bendas stated that without a zoning change she felt 7515 <br />Delmar would be difficult to rent to a family or any tenant who would not want <br />commercial traffic in their driveway. She stated that as next door neighbors and <br />owners, the Bendases would be prepared to watch over the property carefully and keep <br />it an attractive property for the city. Chairman Hamilton stated, however, that the <br />Plan Commission must consider the worst case; they must consider the compatibility of <br />any possible commercial use on that property. Mr. Rice asked if it would be possible <br />to screen the backyard of 7505 Delmar and 7515 Delmar if indeed the backyard would be <br />used for parking. Chairman Hamilton stated that that would be difficult because of <br />the driveway that the two properties would share. <br /> <br />A member of the audience, Mr. Kipling of 7512 Gannon Avenue, stated that he lived in <br />back of the property at 7515 Delmar. He did not want a change in the zoning and would <br />appreciate it if the Bendases would stress to their commercial tenants that their rear <br />yard parking would not be for public parking. Mr. Harry Baker of 7508 Gannon Avenue <br />stated that he lived in back of the property at 7505 Delmar and the proposed parking <br />in the rear yard of that property worried him with regard to water drainage on to his <br />property. Mr. Kennedy stated that with the construction of a parking lot in the rear <br />yard, the Bendases would have to provide a catch basin and have approval by the <br />Metropolitan Sewer District (MSD). Chairman Hamilton stated that the Bendases were <br />free to pave the backyard at 7505 Delmar without any Plan Commission approval. Mr. <br />Kennedy also stressed to Mr. Baker that MSD would only have jurisdiction to prevent <br />
