According to Winco's Development Plan, the <br />connecting structure would be fully enclosed at a future date. Because the original <br />Urban Renewal Plan for the Cunningham Industrial Park called for Maple to be a <br />through-street, Plan Commission approval was required by state statute in order to <br />modify the Plan so that Maple could be blocked between East Park Industrial Drive and <br />Leona Avenue. Ms. Fahey stated that actual vacation of a portion of Maple Industrial <br />Drive would require a Traffic Commission recommendation to City Council and passage of <br />an ordinance. <br /> <br />Mr. McCauley arrived at 7:40 p.m. <br /> <br />Chairman Hamilton asked if the industries located on Maple Industrial Drive in the <br />City of Wellston would be notified of the proposal to vacate a portion of the street. <br />He expressed his concern over how the vacation could affect access to these <br />businesses. Ms. Fahey responded that the Mid-America Steel Company and the Cellucote <br />Company could be accessed from Hays and Leona Avenues as well as from Maple Industrial <br />Drive. She assured the Chairman that these companies would receive the necessary <br />notice regarding the proposal to vacate a portion of Maple in University City. <br />Chairman Hamilton also noted that the Urban Renewal Plan did not allow Winco direct <br />access to Olive Boulevard from its development. <br /> <br />Mr. McCauley and Mr. Adams expressed their concern that if only a one hundred and <br />fifty foot (150') portion of Maple were vacated, the street would exist only for <br />Winco's benefit; however, the City would still be responsible for its maintenance. <br />Mr. McCauley suggested that the Plan be modified to allow the entire street to be <br />vacated from East Park Industrial Drive to Leona Avenue but that the City should <br />retain an easement for the purpose of emergency vehicle access. Mr. Adams also <br />suggested that Winco should be responsible for the street's maintenance. Ms. Fahey <br />stated that the LCRA would support a Plan Commission recommendation for vacation of <br />Maple Industrial Drive from East Park to Leona. This was the LCRA's original <br />recommendation to Winco; however, the Fire Marshal had requested vacation of only the <br />150' portion to facilitate emergency vehicle access and maneuverability. Mr. Goldman <br />stated that if the Plan Commission recommended full vacation of Maple, the LCRA would <br />be bound to make the same recommendation to the Traffic Commission and City Council. <br /> <br />Mr. McCauley moved that the Plan Commission approve modification of the Cunningham <br />Industrial Park Urban Renewal Plan with regard to the vacation of Maple Industrial <br />Drive east to the western edge of Leona Avenue. The City of University City should <br />retain an access easement to Maple Industrial Drive excepting a one hundred and fifty <br />foot (150') section indicated on the site plan presented to the Plan Commission on <br />August 27, 1986. The Winco Ventilator Company should be responsible for the <br />maintenance of Maple Industrial Drive. Mr. Rice seconded the motion which passed by a <br />vote of 6-0. <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT NO. 244-MR.
