<br />. <br /> <br />Minutes - Plan Commission <br />Page 2 <br />May 27, 1987 <br /> <br />. <br /> <br />Mr. McCauley arrived at 7:37 p.m. <br /> <br />Mr. Kendall stated that the applicant should be present to respond to the <br />proposed conditions for the ice cream parlor. Chairman Hamilton stated, <br />however, that Mr. McDaniel had previously agreed to the conditions suggested <br />by Mr. Goldman; the Commission should have no reservations in recommending <br />these conditions to the City Council. Mr. McDaniel would have the opportunity <br />to respond to the recommendation when the City Council considered his <br />application. Chairman Hamilton also stated that it would be appropriate to <br />condition the hours of operation for the ice cream parlor since it could be a <br />matter of concern for the neighborhood. <br /> <br />In reviewing the proposed conditions for the ice cream parlor, Mr. McCauley <br />questioned proposed Condition No. 1 requiring the applicant to completely <br />refurbish the interior and exterior of the building. He suggested that it <br />would be inappropriate to make exterior colors a condition for refurbishing <br />the building; Mr. McCauley suggested that Condition No. 1 be changed to read: <br />"Completely refurbish the interior and exterior area of the building in <br />accordance with a plan approved by the Director of Planning," and Condition <br />No. 2 be changed to read: "Signage shall be as approved by the Director of <br />Planning." Mr. Kendall suggested that an eighth condition be added to the <br />recommendations as follows: "Hours of operation shall be established with the <br />closing time set no later than 11:00 p.m." Ms. Schuman inquired about proposed <br />Condition No.5 which allows for omitting screening for the trash dumpster <br />provided that the dumpster would be "maintained in good condition, free of <br />damage, clean and painted." Mr. Goldman stated that the reason for this <br />proposed condition was because screening for the dumpster is often damaged or <br />deteriorated itself and presents more of an eyesore than only a damaged <br />dumpster. <br /> <br />After further discussion, Ms. Schuman moved that the Plan Commission recommend <br />approval of Mr. McDaniel's application for a Conditional Use Permit subject to <br />the following conditions: <br /> <br />1. Completely refurbish the interior and exterior of the bUilding in <br />accordance with a plan approved by the Director of Planning. <br />2. Signage shall be as approved by the Director of Planning. <br />3. Landscaping shall be installed and maintained in accordance with a <br />landscaping plan approved by the Director of Planning. Such plan shall <br />include replacing the concrete area to the south of the building with <br />landscaping and erecting a railroad tie wall along the west property line <br />to provide a planting bed along the west edge of the parking lot. <br />4. Fence the north side of the parking lot. <br />5. Screening may be omitted at the trash dumpster provided the dumpster is <br />maintained in good condition, free of damage, clean and painted. <br />6. The operator shall provide trash containers on the site, shall clean all <br />litter from the site at least daily, and patrol the vicinity at least once <br />a week to pick up litter scattered by customers. <br />7. The Conditional Use Permit is to be granted to the individual applicant <br />and if the applicant discontinues as principle operator or user of the <br />Conditional Use, the permit shall become null and void. <br />8. Hours of operation shall be established with the closing time set no later <br />than 11:00 p.m. <br />
