Minutes - Plan commis~
Page 3
May 27, 1987

.

The motion was seconded by Mr. Kendall and passed by a vote of 5-0.

APPLICATION FOR CONDITIONAL USE PERMIT NO. 250. ROBERT K. BUCKNER. LIVING WORD
APOSTOLIC CHURCH AT 7740 OLIVE BOULEVARD

Chairman Hamilton stated that the Commission would conduct the public hearing
for the Conditional Use Permit application by Mr. Robert Buckner in order to
allow use of the premises at 7740 Olive Boulevard for the Living Word
Apostolic Church. Mr. Buckner stated that his church organization wanted to
purchase the building at 7740 Olive which was previously owned and occupied by
the Fine Arts Theater. He stated that the bUilding had a seating capacity of
675 and now stood vacant. It was an ideal location for his church on a corner
and with a large parking lot. Chairman Hamilton asked Mr. Buckner about the
statements in his application that there was no current congregation for the
church. Mr. Buckner stated that his congregation was a newly established
satellite of the Lively Stone Church of God currently located at 4015 St.
Louis Avenue. He further explained that the Lively Stone Church would provide
financial support for the satellite church.

Chairman Hamilton asked Mr. Goldman to comment on the application. Mr.
Goldman stated that he was unable to give a complete review of the application
since several pieces of important information were not submitted. First, if
the building currently seated 675 people, the Zoning Code required that the
church provide 168 parking spaces for the church use. Mr. Buckner replied
that he proposed to enlarge the stage area of the theater which would leave
less than 550 seats. Mr. Goldman stated that a plan of the parking layout
would be required. Mr. Buckner replied that the parking lot would be paved
and that he could provide a parking lot plan. Mr. Goldman also stated that he
would require a landscaping plan, a floor plan of the existing interior
conditions and any proposed changes, elevation studies of the exterior with
any proposed changes, and information on the corporate status of the Living
Word Apostolic Church and the mother church. Mr. Buckner stated that he could
provide this information. Mr. Washington stated that he was quite familiar
with the mother organization, the Lively Stone Church of God, and suggested
that Mr. Buckner bring in information about the successful expansion plans of
the Lively Stone Church in order to support his application for the Conditional
Use Permit at this location.

After further discussion, Mr. McCauley moved that the Plan Commission
recommend denial of the application with the stipulation that the applicant
may return to the Plan Commission for reconsideration of the application
within the next six months without payment of additional fees. Chairman
Hamilton suggested that the applicant meet with Planning staff to review the
requirements for resubmission of his application. Mr. Kendall seconded the
motion which passed by a vote of 5-0.

APPLICATION FOR CONDITIONAL USE PERMIT NO. 251. PANTERA'S PIZZA. CARRY-OUT
RESTAURANT AT 8448 DELMAR BOULEVARD

Chairman Hamilton stated that the Plan Commission would conduct a public
hearing on the application for a Conditional Use Permit by Mr. Robert
Derrington of J & B Investment, Inc., dba Pantera's Pizza.
