<br />. <br />Minutes - Plan Commission <br />Page 4 <br />May 27, 1987 <br /> <br />. <br /> <br />proposed to open a carry-out restaurant at 8448 Delmar Boulevard. Chairman <br />Hamilton noted that no one was present representing the applicant. <br /> <br />Mr. Goldman stated that the proposed location for the restaurant was suitable <br />for a limited carry-out use and delivery service. His primary concern, <br />however, centered on landscaping of the parking lot for the entire Delcrest <br />Plaza complex; he proposed that proper landscaping be a condition of this <br />tenant's occupancy. He stated that the proposed restaurant would seat 60 or <br />more people; however, in order to facilitate parking in the area, he suggested <br />that the Commission recommend a limitation on the number of home delivery <br />vehicles the restaurant should have. A previous traffic study for the site <br />supported the conclusion that a restaurant use would be compatible with the <br />area and that there would be ample parking available. Ms. Schuman asked about <br />the number of video games that the restaurant would most likely have. Ms. <br />Elwood stated that, according to the Zoning Code, the business would be <br />allowed at least two video machines; three or more video machines at one <br />business would require a Conditional Use Permit. Mr. McCauley asked if it was <br />appropriate to condition Pantera's occupancy on landscaping of the parking lot <br />for the entire complex. Commission members agreed with Mr. Goldman that this <br />was an appropriate condition. Chairman Hamilton suggested an additional <br />condition be added to the recommendation that the permit be limited to <br />occupancy of the premises by Pantera's Pizza. <br /> <br />After further discussion Mr. McCauley moved that the Plan Commission recommend <br />approval of Mr. Derrington's application for a Conditional Use Permit subject <br />to the following conditions: <br /> <br />1. Submit a parking lot landscaping plan to the Director of Planning for <br />review and approval. Install and maintain landscaping in accordance with <br />the approved plan. The plan must be approved before the occupancy permit <br />is issued. All landscaping shown on the approved plan shall be completed <br />on or before November 15, 1987. <br />2. The dining area shall provide seating for 60 or more diners. <br />3. No more than three home delivery vehicles shall be parked or stored on the <br />premises at anyone time. <br />4. Refuse storage shall be sized and located as approved by the Director of <br />Public Works. <br />S. This Conditional Use Permit is limited to occupancy of the premises at <br />8448 Delmar Boulevard by Pantera's Pizza only and any change in restaurant <br />use, carry-out or otherwise, will require approval of a separate use permit. <br /> <br />Mr. Washington seconded the motion which passed by a vote of 5-0. <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT NO. 251. RICHARD AND MARTHA PARMLEY. <br />DBA MANGIA ITALIANO. INC..
