She <br />stated that she had not solicited enrollment for the center but many people <br />in the neighborhood had already signed up for day care beginning September <br />8th. She informed Commission members that she had previous day care <br />experience as an elementary school teacher and a licensed day care <br />administrator in Michigan. She would have no problem preparing the Church's <br />center for approval by the fire marshal, sanitation department and the health <br />department. <br /> <br />Ms. Schuman commended Mrs. Pembleton on the church voluntarily seeking State <br />licensing and asked what were the ages of the children being cared for. Mrs. <br />Pembleton stated that the childrens' ages would range from 6 weeks to 12 <br />years and that the church hoped to institute an after-school tutorial <br />program. She added the church hoped to acquire a vacant lot across the <br />street for future parking. Ms. Kreishman asked if the proposed play yard for <br />the day care center would be fenced before State licensing was obtained. <br />Mrs. Pembleton said that if the day care center could open before the State <br />license was granted, the fence for the play yard would be in place. Mr. <br />Washington asked if the outdoor activity of the children could be a <br />bothersome source of noise in the neighborhood. Mrs. Pembleton said that <br />State recommends between 5 and 20 minutes of outdoor play for the children, <br />weather permitting. Only one-third of the children are outdoors at anyone <br />time. She indicated that the building next door to the church on the west is <br />not a residence. Mr. Marsh asked what were the proposed hours of operation <br />for the center. Mrs. Pembleton replied that the hours would be from 6 a.m. <br />to 5:30 p.m. Mr. Rice indicated that a State license was the ultimate proof <br />that a day care center met State standards and that a license could be lifted <br />upon any violation of those standards. Mr. Goldman agreed that operation of <br />the day care center before State licensing would leave open the possibility <br />that the day care center did not meet State standards before the license was <br />granted. Ms. Schuman agreed that State licensing was a good indication of <br />the day care center's quality. Mr. Ollendorff suggested that the City <br />Council could review all the City inspections of the premises and would <br />consider allowing Mrs. Pembleton to open the center before a State license <br />was granted. <br /> <br />After further discussion, Mr. Rice moved that the Plan Commission recommend <br />approval of the application for a Conditional Use Permit by the Agape <br />Seventh-Day Adventist Church for a day care center subject to the following <br />conditions: <br /> <br />1. Child day care shall be provided for no more than twenty (20) children at <br />anyone time. <br /> <br />2. The Agape Seventh-Day Adventist Church shall waive its exemption from <br />State statutes and rules governing the design and operation of day care <br />centers and shall not use the premises at any time as a child day care <br />facility unless duly licensed by the State of Missouri. <br />
