<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 5 <br />August 26, 1987 <br /> <br />Ms. Kreishman seconded the motion. Mr. Rice suggested that Mrs. Pembleton <br />have all licensing and inspection information ready to present to the City <br />Council. Mr. Adams agreed and stated that Mrs. Pembleton could request of <br />the City Council that she be allowed to open the Center before obtaining the <br />State license. The motion was approved by a vote of 7-0. <br /> <br />REQUEST TO SUBDIVIDE PROPERTY AT 1435 WOODSON ROAD BY MASSMAN STEPHANS AND <br />POEHLMAN. INC. <br /> <br />Chairman McCauley called on Mr. Ron Compton, an attorney for Tomeo, Inc. a <br />company which proposed to sell a portion of its property to its northern <br />neighbor, the Weise Planning & Engineering Co., thus prompting a request to <br />subdivide the property at 1435 Woodson Road. He stated that after the Plan <br />Commission's rejection of the proposed subdivision in June, the surveyor had <br />corrected the survey to eliminate the creation of an additional lot. The <br />current survey submitted to the Commission on July 29, 1987, merely indicated <br />a change in the boundary lines of the two properties. <br /> <br />Chairman McCauley inquired if the broken line on the proposed subdivision <br />plat indicated the property line which was being relocated. Mr. Compton <br />stated that this was a correct depiction. Ms. Kreishman asked if the <br />subdivision plat should include a legal description of the properties. Ms. <br />Elwood stated that a legal description of the property was not a requirement <br />of the City subdivision ordinance. <br /> <br />Ms. Schuman moved that the Plan Commission approve the subdivision of <br />property at 1435 Woodson Road in accordance with the subdivision plat <br />submitted to the Commission on July 29, 1987, and labeled "T.K.G. <br />Subdivision." Mr. Rice seconded the motion which passed by a vote of 7-0. <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT NO. 256. NUZ-PUDZ. INC.. CARRY-OUT <br />RESTAURANT AT 8600 OLIVE BOULEVARD <br /> <br />Chairman McCauley indicated that the Plan Commission had scheduled a public <br />hearing on an application by Mr. Patrick Judd dba Nuz-Pudz, Inc. in order to <br />allow the premises at 8600 Olive Boulevard to be used as a carry-out restaurant. <br /> <br />Mr. Patrick Judd explained to Commission members that his business, Nuz-Pudz, <br />Inc., had obtained an occupancy permit for the 8600 Olive Boulevard location <br />for a catering office to oversee delivery of Amighetti's food products to the <br />Clayton business community. Nuz-Pudz, Inc. was now seeking approval for a <br />carry-out restaurant at this location in order to sell Amighetti's food <br />products to the public. <br /> <br />Chairman McCauley asked Mr. Goldman for his response to the application. Mr. <br />Goldman stated that his recommendation to deny the Conditional Use Permit was <br />based on a conflict of this application with a Site Plan recently approved by <br />the City Council for an expansion of the retail/office use by Famous Brand <br />Shoes on the site. Mr. Goldman further indicated that after he learned of <br />the relationship of the partners of Nuz-Pudz, Inc. to the site's developer, <br />
