<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 6 <br />August 26, 1987 <br /> <br />he had no objection to a carry-out restaurant as an interim use of the <br />premises at 8600 Olive Boulevard. He stated that the Famous Brand Shoe <br />development proposal could be a phased one; he did not believe that there <br />would be any conflict with an interim carry-out restaurant use. Mr. Goldman <br />showed Commission members the development proposal approved by the City <br />Council. He explained that if the site were developed according to the Site <br />Plan, it could affect the available parking and use of the carry-out space on <br />the site. <br /> <br />Ms. Schuman asked Mr. Judd to confirm that Nuz-Pudz, Inc. had received a <br />business occupancy permit for 8600 Olive. Mr. Judd stated that his company <br />had received an occupancy permit for a catering office, not for a carry-out <br />restaurant. Ms. Kreishman asked if Nuz-Pudz was under contract with <br />Amighetti's Bakery to sell its products at this site. Mr. Judd stated that <br />they were contracted by Amighetti's Bakery, and not Anheuser-Busch, to sell <br />prepackaged sandwichs and salads, chips and soda at the Olive Boulevard site; <br />the food was quality-controlled by the Amighetti operation. Chairman <br />McCauley called on Mr. Tage Howes, 1157 North McKnight Road. Mr. Howes <br />wished to comment on the Conditional Use Permit application. Mr. Howes <br />expressed his concern regarding a carry-out restaurant use at the 8600 Olive <br />Boulevard location because of past experience with the Dairy Queen operation <br />at the same location. He continued by saying that Dairy Queen had generated <br />a lot of litter in the surrounding neighborhood as well as a lot of <br />late-night foot traffic. Mr. McCauley asked Mr. Judd to respond to these <br />concerns. Mr. Judd stated that he would hire a maintenance or small <br />janitorial crew, and that he would establish a policy with his workers to <br />police the area for litter. He also stated that the drivers for the catering <br />service would be driving past the McKnight neighborhood and could monitor any <br />potential litter problems. Mr. Kendall asked Mr. Judd about potential <br />signage for the property. Mr. Judd stated that he proposed a window sign and <br />perhaps an awning sign to advertise the business. Ms. Elwood stated that a <br />current paper window sign was displayed at 8600 Olive, and that a permit had <br />not been issued for the sign. The sign needs to be removed until a permit is <br />issued. Mr. Adams asked what the proposed hours of operation would be for <br />the business. Mr. Judd responded that the hours of operation were dictated <br />by the Amighetti's supply; he would not be able to open before 10 a.m. and <br />would not be able to supply any food after 6:30 p.m. Mr. Howes asked if Mr. <br />Judd proposed to use the walk-up service window on the McKnight side of the <br />building. Mr. Howes speculated that use of this window might encourage foot <br />traffic and littering. Mr. Judd stated that he did not plan to use the <br />walk-up window. Mr. Howes asked Commission members if they would consider <br />requiring the applicant to police the McKnight neighborhood for litter as <br />well as the area between the fence and Mayflower Court. Chairman McCauley <br />asked Mr. Judd if he planned to serve food products other than those of <br />Amighetti's. Mr. Judd stated that his operation was strictly licensed to <br />sell Amighetti products only, he did not anticipate the need for a beer or <br />liquor license. Ms. Kreishman asked about possible limitation of the <br />carry-out use to an interim use. Mr. Goldman stated that the Commission and <br />Council could restrict the Use Permit to a time limit after completion of the <br />proposed work by Famous Brand Shoes approved by Site Plan Review No. 1172. <br />
