<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 7 <br />August 26, 1987 <br /> <br />After further discussion, Mr. Kendall moved that the Plan Commission <br />recommend the approval of the application by Nuz-Pudz, Inc. for a Conditional <br />Use Permit for a carry-out restaurant subject to the following conditions: <br /> <br />1. Hours of operation shall be established with opening hours no earlier <br />than 10 a.m. and closing hours no later than 6:30 p.m. <br /> <br />2. The operator shall regularly police the area adjacent to the restaurant <br />as well as the area from the fence behind the business, south to <br />Mayflower Court, to remove litter and debris. <br /> <br />3. Signage for the business shall be in strict compliance with the <br />University City Sign Code. <br /> <br />4. Trash containers for patron use shall be available on the premises at all <br />times. <br /> <br />5. Adequate refuse disposal shall be provided for the business. <br /> <br />6. This permit is granted to the applicant, Patrick Judd dba Nuz-Pudz, Inc., <br />and if the applicant discontinues as the principal operator or user of <br />this Conditional Use, this permit shall be null and void. <br /> <br />Mr. Marsh seconded the motion which passed by a vote of 7-0. <br /> <br />APPLICATION FOR A CONDITIONAL USE PERMIT NO. 257. ROBIN AND DAN WALD. <br />CARRY-OUT RESTAURANT SPACE AT MARKET-IN-THE-LOOP. 6655 DELMAR BOULEVARD <br /> <br />Chairman McCauley stated that the Plan Commission had scheduled a public <br />hearing on an application for a Conditional Use Permit in order to allow a <br />portion of the premises at the Market-in-the-Loop to be used for carry-out <br />restaurant space. Mr. Dan Wald introduced himself to Plan Commission members <br />as the proponent of a development plan to enclose a portion of the Market-in- <br />the-Loop at 6655 Delmar Boulevard for year-round use. He stated that in <br />meeting with Mr. Ollendorff, City Manager, and Planning Department staff, it <br />was suggested that he, as the developer, apply for a "blanket" Conditional <br />Use Permit in order to allow him to lease a maximum of eight stalls or eight <br />hundred (800) square feet for various carry-out restaurant operations in the <br />proposed enclosure of the Market-in-the-Loop. In this way he would be able <br />to control carry-out restaurant usage through the leases. <br /> <br />Mr. Goldman responded to the application by stating that the Market-in-the- <br />Loop currently has two carry-out restaurant tenants and could have more if <br />the area were enclosed thereby making restaurant usage comply with County <br />Health Department standards. He stated that by applying for the Conditional <br />Use Permit, the Market operator would have control over the restaurant <br />conditions and restrictions. <br /> <br />Mr. McCauley indicated that Plan Commission members were interested in more <br />general information concerning the proposed Market development even though <br />these issues would be considered by the City Council in their review of the <br />
