Minutes - Plan Commission Page 7 August 26, 1987 After further discussion, Mr. Kendall moved that the Plan Commission recommend the approval of the application by Nuz-Pudz, Inc. for a Conditional Use Permit for a carry-out restaurant subject to the following conditions: 1. Hours of operation shall be established with opening hours no earlier than 10 a.m. and closing hours no later than 6:30 p.m. 2. The operator shall regularly police the area adjacent to the restaurant as well as the area from the fence behind the business, south to Mayflower Court, to remove litter and debris. 3. Signage for the business shall be in strict compliance with the University City Sign Code. 4. Trash containers for patron use shall be available on the premises at all times. 5. Adequate refuse disposal shall be provided for the business. 6. This permit is granted to the applicant, Patrick Judd dba Nuz-Pudz, Inc., and if the applicant discontinues as the principal operator or user of this Conditional Use, this permit shall be null and void. Mr. Marsh seconded the motion which passed by a vote of 7-0. APPLICATION FOR A CONDITIONAL USE PERMIT NO. 257. ROBIN AND DAN WALD. CARRY-OUT RESTAURANT SPACE AT MARKET-IN-THE-LOOP. 6655 DELMAR BOULEVARD Chairman McCauley stated that the Plan Commission had scheduled a public hearing on an application for a Conditional Use Permit in order to allow a portion of the premises at the Market-in-the-Loop to be used for carry-out restaurant space. Mr. Dan Wald introduced himself to Plan Commission members as the proponent of a development plan to enclose a portion of the Market-in- the-Loop at 6655 Delmar Boulevard for year-round use. He stated that in meeting with Mr. Ollendorff, City Manager, and Planning Department staff, it was suggested that he, as the developer, apply for a "blanket" Conditional Use Permit in order to allow him to lease a maximum of eight stalls or eight hundred (800) square feet for various carry-out restaurant operations in the proposed enclosure of the Market-in-the-Loop. In this way he would be able to control carry-out restaurant usage through the leases. Mr. Goldman responded to the application by stating that the Market-in-the- Loop currently has two carry-out restaurant tenants and could have more if the area were enclosed thereby making restaurant usage comply with County Health Department standards. He stated that by applying for the Conditional Use Permit, the Market operator would have control over the restaurant conditions and restrictions. Mr. McCauley indicated that Plan Commission members were interested in more general information concerning the proposed Market development even though these issues would be considered by the City Council in their review of the
