Mr. Goldman stated that Mr. Wald's initial plan had included <br />enclosure of the entire Market property for year-round use; however, some of <br />the produce vendors wish to remain in outdoor stalls for lower rents. A <br />portion of the Market needs to be enclosed to accomodate the required <br />plumbing and electrical facilities in order for the County Health Department <br />to approve carry-out restaurant uses. Some vendors have requested enclosed <br />spaces for better refrigeration facilities. Mr. Adams indicated that once a <br />portion of the Market was enclosed, it did not preclude further enclosure of <br />the Market at a future date. Mr. Rice expressed his concern over the <br />proposed enclosure of the Market. He felt that the Market was originally <br />intended as a temporary measure for use of vacant land; he further stated his <br />belief that the Market, either enclosed or unenclosed, was not compatible <br />with the Loop's Retail Commercial zoning. He stated that both the proposed <br />structure and the current structure do not match the height and mass of the <br />surrounding commercial buildings. Mr. Ollendorff agreed with Mr. Rice; he <br />stated, however, that given the development problems with the particular site <br />and past efforts to market the vacant tracts along Delmar, no viable, <br />permanent retail development plans have been submitted to the City. He <br />stated that the City does favor large retail buildings, for which there does <br />not seem to be a market, given the size and development opportunities of this <br />particular site. Mr. Wald stated that he had received input from many <br />citizens and vendors who want some type of market on the site; he believes <br />that the Market brought many people to the area from which other retail <br />developments benefit. Mr. Wald further explained that eight stalls or eight <br />hundred (800) square feet of proposed carry-out restaurant space does not <br />necessarily mean that there would be eight restaurants in the enclosed <br />building. Some restaurants may want to rent more than one space; and indoor <br />spaces are also available for vendors. Ms. Kreishman asked how large the <br />enclosed portion of the proposed Market would be. Mr. Wald responded that <br />the enclosed building would be 3,500 square feet and that 800 square feet of <br />this could be used for carry-out restaurant space, if approved. Mr. Rice <br />asked about plans for seating within the enclosed area or the open area east- <br />of the Market. Mr. Wald stated that he may provide some outdoor furniture, but <br />that the property east of the Market building would be owned by the City. <br />Ms. Schuman stated that the open area to the east could become a problem with <br />late night congregation and might be a concern of the businesses to the east. <br />She suggested that portable tables and chairs should not be left outside to <br />encourage these problems. Mr. Ollendorff stated that the City would be <br />responsible for planting areas and any permanent seating areas on the eastern <br />portion of the site. Ms. Kreishman asked about the proposed hours of <br />operation of the Market. Mr. Wald stated that some restaurant uses may not <br />be open past the dinner hour, but some uses, such as an ice cream parlor, may <br />wish to be open later in the evening. <br /> <br />After further discussion, a motion was made by Mr. Marsh that the Plan <br />Commission recommend approval of the application for a Conditional Use Permit <br />for carry-out restaurant usage at 6655 Delmar subject to the following <br />conditions: <br /> <br />1. Hours of operation shall be limited to those between 7 a.m. and 11 p.m. <br /> <br />2. Total space devoted to the preparation, storage and sales related to <br />carry-out restaurant uses exclusive of patron seating areas shall not <br />exceed 800 square feet of floor area. <br />
