<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />March 23, 1988 <br />Page 2 <br /> <br />members the list of violations of Conditional Use Permit #219 which had been <br />detailed during a March 11, 1988, inspection. Mr. Nuriddin stated that the <br />deteriorated fence on the north side of the property actually belonged to <br />the property at 1165 Ferguson Avenue and, therefore, Mr. Buchanan was not in <br />a position to replace or repair it. He further explained that Mr. Buchanan <br />had made efforts on more than one occasion to plant shrubbery along Plymouth <br />Avenue but felt that neighborhood children were pulling the plants out of <br />the ground and stealing them. Mr. Buchanan also had problems preventing <br />people from painting graffiti on the back of hi. building. Mr. Buchanan was <br />requesting that the Commission continue its consideration of his application <br />for an amendment to Conditional Use Permit #219 until its next meeting so <br />that he would have time to correct the violations cited on his property. <br /> <br />Chairman McCauley asked Al Goldman, Director of Planning, to present the <br />issues cited in the Planning Department's report on the application. Mr. <br />Goldman informed Commission members that this was not Mr. Buchanan's first <br />application for an amendment of the Conditional Use Permit governing his <br />auto repair facility on Ferguson Avenue. He stated that Mr. Buchanan has <br />requested amendment. to his Conditional Use Permit after several citations <br />for parking extra vehicles on the property overnight. The conditions under <br />which Mr. Buchanan operates his business were originally agreed to by him in <br />1983. This was the first time that the Plan Commission had heard the <br />argument that the fence on the north side of the bUilding at 1163 Ferguson <br />Avenue did not belong to the property Mr. Buchanan leased. Mr. Goldman <br />further explained that an inspection the previous night revealed one <br />unlicensed vehicle and one vehicle with a "For Sale" sign in the windshield _ <br />both parked on the property. These were violations of the Municipal Code as <br />well as the Zoning Code. Mr. Goldman's original reco~endation that the <br />Plan Commission not consider the application until the applicant brinss the <br />premises into full compliance with the spirit and intent of the conditions <br />of Use Permit #219 has changed because of the recently documented violations <br />of the City Code. Mr. Goldman therefore recomaended denial of the <br />application outright. <br /> <br />Chairman McCauley asked Mr. Nuriddin to respond to questions from Plan <br />Commission members. Ms. Kreishman asked why the number of cars parked <br />overnight on the premises had been limited by the original permit. Mr. <br />Goldman responded that the number of cars was set at three because of <br />concern for uncontrolled overnight parking vehicles in a residential <br />neighborhood. Mr. Kendall stated that it was his impression that a motor <br />vehicle repair use adjacent to a residential neighborhood could be <br />compatible with the neighborhood; however, the debris on the property, the <br />poorly maintained fence and other violations which he had observed indicated <br />that this business was not compatible with the surrounding neighborhood and <br />demonstrated a lack of recognition on the part of the owner that the <br />neighboring public would patronize a compatible business. <br /> <br />Chairman McCauley asked if any members of the public had any questions or <br />concerns about the application. Mr. Ben Strawder of 6806 Plyaouth Avenue <br />stated that he lived directly across the street from the Carriben Auto <br />Repair and had noted over the past years that more than three cars were <br />
