Sometimes a tow truck was <br />parked on the property; however, all vehicles parked overnight on the <br />property were there when the business owner left for the evening. He stated <br />that cars parked at the rear of the property in the alley and the constant <br />debris and derelict vehicles were unsightly to neighbors. Bette Strawder of <br />6806 Plymouth Avenue stated that the same five cars had been parked on the <br />lot during the past week and that the unsightly condition of the property <br />had a deleterious effect on the entire neighborhood. She also stated that <br />sometimes cars were displayed as being "For Sale" on the property. She <br />stated that, to her knowledge, Mr. Buchanan had replaced some plantings <br />along Plymouth Avenue, but they have since died. Mr. Frank Elliot of 6804 <br />Plymouth Avenue stated that the property had been the site of an automobile <br />service station since 1964 and had previously been operated neatly and <br />quietly; however, since Mr. Buchanan has been operating the business, there <br />have been many tow trucks and wrecked cars on the property overnight. He <br />was not in favor of granting the amendment to the Use Permit. Frank <br />Ollendorff, City Manager, informed Commission members that the complaints on <br />and inspections of the property had cost the City many tax dollars in trying <br />to correct violations on the property. He stated that the City had put <br />forth much effort to prevent junk cars and other derelict vehicles from <br />being parked in residential neighborhoods, and the example set by Carriben <br />Auto Repair on the corner of Ferguson and Plymouth did not exemplify the <br />City's efforts in this area. <br /> <br />After further discussion, Mr. Marsh moved that the Plan Commission recommend <br />denial of the requested amendment to Conditional Use Permit #219 because of <br />the potential deleterious effect on the surrounding neighborhood. Mr. <br />Kendall seconded the motion. Chairman McCauley called for a discussion on <br />the motion. Mr. Rice asked if the Commission would not sug.est that the <br />applicant could return to the Commission within ninety days without payment <br />of additional fees for consideration of the amendment if the property was <br />brought up to code. Mr. Goldman stated that the fee waiver was not a part <br />of Mr. Marsh's motion and he did not recommend such an option. Chairman <br />McCauley called for a vote on the motion which passed by a vote of 7-0. Mr. <br />Goldman stated to Mr. Nuriddin that the conditions of Use Permit #219 still <br />remained in force and effect in regards to the property at 1163 Ferguson <br />Avenue. <br /> <br />APPLICATION FOR AMEHDMENT TO COHDITIONAL USE PERMIT #257. DAN AND ROBIN <br />WALD. MARKET-IN-THE-LOOP. 6655 DELMAR BOULEVARD <br /> <br />Chairman McCauley stated that the Plan Commission had scheduled a public <br />hearing on a request to amend Conditional Use Permit '257 by Dan and Robin <br />Wald in order to allow for an increased area and amended plans for carry-out <br />restaurant space in the new Market-in-the-Loop building. Mr. Safe stated <br />that as he had a direct conflict of interest with the Commission's <br />deliberation of the request, he would abstain from any discussion or vote. <br /> <br />Chairman McCauley called on the applicant to present information on the <br />requested amendment. Mr. Dan Wald, developer of the new Market building, <br />requested a change in Use Permit #257 in order to allow up to 2,360 square <br />feet (the total building area> for carry-out restaurant use.
