He explained that Mangia <br />Italiano, a grocer of Italian foods, was interested in leasing 660 square <br />feet, an ice cream parlor operated by Robin Wald would occupy 400 square <br />feet, the Med Cafe, a Lebanese carry-out, had requested leasing 200 square <br />feet and a Chinese restaurant had expressed an interest in leasing 210 <br />square feet. He explained that there was a potential for further interest <br />in leasing carry-out restuarant space in the building. Mr. Wald's second <br />reason for requesting an amendment of Conditional Use 1257 was to amend <br />plans for the building in order to locate a carry-out window on the Delmar <br />Boulevard frontage for the frozen custard stand. He stated that there would <br />be some outdoor seating added on the west side of the buildina and the <br />property east of the bUilding was still planned as a public plaza. Chairman <br />McCauley asked Mr. Wald what was the total floor area to be leased for <br />carry-out restaurant space. Mr. Wald stated that the four above-mentioned <br />tenants could lease 1,470 square feet of floor area. <br /> <br />Chairman McCauley asked Kr. Goldman to present the issues cited in the <br />Planning Department's report on the application. Mr. Goldman stated that <br />under the current Use Permit, approximately 1/3 of the leasable space in the <br />building could be devoted to carry-out restaurant use. He felt that while <br />some adjustment in the 800 square foot limitation on carry-out use would be <br />appropriate, it would be inconsistent with the original purpose of the <br />building, a year-round food market, for the entire floor area devoted to <br />carry-out restaurant space. Mr. Goldman recommended denial of the custard <br />stand walk-up window to serve patrons from the public sidewalk because the <br />applicant had not established that it would promote the community welfare <br />and convenience and, at the same time, not cause substantial injury to the <br />value of neighboring property. The proposal did not comply with the overall <br />neighborhood development plan. <br /> <br />Chairman McCauley asked the applicant to respond to questions from Plan <br />Commission members. Mr. Rice expressed his concern for how various spac.s <br />such as that occupied by Kangia Italiano would be classified. He questioned <br />whether Manaia Italiano's retail sale of packaged food qualified it as a <br />carry-out restaurant. Mr. Wald stated that he had considered the same <br />question; however, Mangia Italiano did propose to serve light sandwiches and <br />coffees or soda in conjunction with its sales of packaged food. Ms. <br />lreishman asked if the four potential carry-out tenants had signed leases <br />for the specific spaces. Mr. Wald stated that they had signed letters of <br />intent to lease the amount of square footage previously listed. <br /> <br />Ms. Kreishman, Chairman McCauley and other Commission members expressed <br />their opinion that the original intent of enclosing a portion of the Market <br />was to provide facilities that met health and safety codes; however, both <br />the indoor and outdoor portions of the Market should fulfill the purpose of <br />a year-round food market. Co~is8ion members stated that a chanae in the <br />indoor spaces to entirely carry-out restaurants indicated a chance in the <br />developer's original approach. <br />
