<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 4 <br />September 28, 1988 <br /> <br />Mr. Kendall seconded the motion which passed by a vote of 6-0 with one <br />abstention. <br /> <br />APPLICATION FOR AMENDMENT OF CONDITIONAL USE PERMIT #256 - NUZ-PUDZ. INC. AT 8600 <br />OLIVE BOULEVARD <br /> <br />Chairman McCauley informed those present that the Plan Commission had scheduled a <br />public hearing on an application for amendment of Conditional Use Permit #256 by <br />Mr. Patrick Judd, representing Nuz-Pudz, Inc. at 8600 Olive Boulevard in order to <br />permit extension of the operation for an outdoor dining area. <br /> <br />Chairman McCauley called on the applicant to present information on the <br />application. Mr. Judd stated that he had submitted drawings with the application <br />which depicted the new patio area to the east of his business premises which he <br />planned to enclose with a fence. He would put patio tables and chairs in the <br />enclosed area for those customers wishing to eat on the premises rather than <br />carry-out. <br /> <br />Chairman McCauley called for Mr. Goldman's report on the application. Mr. <br />Goldman responded that while the drawings submitted with the application lacked <br />specificity, the patio extension did not eliminate any required or critical <br />parking spaces for the operation or for the other businesses in the complex. He <br />concluded that the patio enclosure does no great violence to the overall scheme <br />of the shopping center in which this business is located. <br /> <br />Mr. Judd indicated that he is also requesting an extension in his hours of <br />operation to 8:30 p.m. After some discussion concerning Mr. Judd's efficient <br />business operation and lack of litter problems on the site, Mr. Rice moved that <br />the Plan Commission recommend approval of the application to amend Conditional <br />Use Permit #256, thereby extending the business's hours of operation to 8:30 p.m. <br />and permitting the outdoor dining area so long as the chairs used outside be <br />stored indoors each evening. All other conditions of Use Permit #256 should <br />remain in full force and effect. Mr. Marsh seconded the motion which passed by a <br />vote of 7-0. <br /> <br />REQUEST TO REZONE 1.5 ACRE PARCEL AT BLACKBERRY AVENUE. SOUTHEAST OF RIVER DES <br />PERES FROM "PA" TO "PR-O" BY MARK CONNER BUILDER & DEVELOPER. INC. AND RICHARDS <br />BRUNO, INC. <br /> <br />Ms. Elwood informed Chairman McCauley that the applicants had requested that <br />their application be withdrawn from the agenda due to a change in their <br />contractual status on the property. <br /> <br />PRESENTATION OF OLIVE BOULEVARD CENTRAL TAX INCREMENT FINANCE DISTRICT <br />REDEVELOPMENT PLAN <br /> <br />Mary Fahey, Assistant Director of Planning, reminded Commission members that at <br />its August 10th and August 24th meetings the Plan Commission had reviewed the Tax <br />Increment Financing (TIF) concept as it related to Olive Boulevard in University <br />City. Members had received the final draft of the Olive Boulevard Central TIF <br />Plan which had been adopted by the University City TIF Commission.
