<br />Minutes - Plan commissio~ <br />Page 2 <br />November 22, 1989 <br /> <br />. <br /> <br />The Chairman inquired whether the restaurant's Conditional Use Permit anticipated <br />adequate requirements for landscaping on the extra land it proposed to purchase. <br />Ms. Elwood read the Condition #5 of Dubbles' Use Permit, #270A-2nd Amendment, which <br />states that: <br /> <br />If vehicular access to the site can be arranged from the adjoining property <br />to the south, the internal driveways and parking lot layout can be changed <br />to accommodate the new access, and the existing driveway entrance from Midland <br />to the site can be limited to outbound traffic only, provided such changes are <br />first received and approved by the Director of Planning. <br /> <br />Mr. Marsh then moved that the Plan Commission approve U-Haul's request for subdivision <br />of its property as submitted on the record plat entitled "U-Haul Center." Mr. <br />Washington seconded the motion which passed by a vote of 5-0. <br /> <br />Mr. Rice arrived at 7:38 p.m. <br /> <br />REQUEST FOR SUBDIVISION - CONDOMINIUM PLAT FOR "ONE MC KNIGHT PLACE, A CONDOMINIUM." <br /> <br />Chairman McCauley called on Charles Deutsch of the One McKnight Place Partnership to <br />present the request for approval of the condominium plat. Mr. Deutsch stated that the <br />proposal to divide the apartment units of the One McKnight Place Retirement Center <br />into condominium units was not intended to accommodate the individual sale of the <br />units, but to qualify the partnership for the County's residential property tax <br />classification. Mr. Marsh stated that he would abstain from any discussion or vote on <br />the subdivision request due to a conflict of interest. <br /> <br />The Chairman asked if Mr. Goldman had anything to add to the staff report on the <br />subdivision request. Mr. Goldman stated that the staff report fully explained the <br />issue and coincided with Mr. Deutsch's explanation. <br /> <br />Chairman McCauley asked Mr. Deutsch if the easement along the east side of the <br />property were indeed retained by the City of St. Louis. Mr. Deutsch replied that this <br />easement contained a main conduit from the Missouri River to the City of St. Louis. <br />Chairman McCauley asked if certain easements indicated on the plat should continue to <br />Delmar Boulevard. Mr. Deutsch stated that they probably did continue to Delmar; <br />however, the Barby Lane right-of-way was the right-of-way immediately to the north of <br />the One McKnight Place property. Mr. Safe asked if, because of the condominium <br />subdivision, the apartment units could be sold individually. Mr. Goldman stated that <br />certain state statutory requirements might place notification or waiting period <br />requirements on the partnership before selling any unit. Also, because the <br />development was approved by the City as apartments for the elderly, a lower parking <br />ratio was permitted. Mr. Deutsch indicated that the Deed of Trust on the property <br />from the Federal Department of Housing and Urban Development prohibited any other use <br />of the building than that of elderly apartments. <br /> <br />After a brief discussion, Mr. Kendall moved that the Plan Commission approve the <br />request for subdivision entitled "One McKnight Place, A Condominium." Mr. Rice <br />seconded the motion which passed by a vote of 5-0 with 1 abstention. <br />
