The use permit shall be limited to operation of a carry-out barbecue restaurant by <br />Roderick and Virginia Bell doing business as U. City Barbecue. Operation of the carry_ <br />out restaurant by any other owner or operator or change in the type of restaurant so <br />operated without the express approval of the Plan Commission and City Council shall <br />render this permit and the occupancy permit for the business null and void. <br /> <br />9. Hours of operation shall be limited to the period between 11 a.m. and 11 p.m. except <br />on Friday and Saturday nights when the business shall operate no later than 12 midnight. <br /> <br />10 Windows that are closed in shall be covered with decorative plywood to match or blend <br />with surrounding masonry. <br /> <br />It was pointed out to the applicants by Mr. Marsh that it was the intention of the motion to <br />exclude any reference to phasing of the landscape development because the Plan Commission <br />did not find such phasing acceptable. The motion was approved by a vote of 5-1. <br /> <br />REOUEST FOR EXTENSION OF CONDITIONAL USE PERMIT #276 - AGUDAS ISRAEL <br />OF ST. LOUIS SYNAGOGUE AT 8302-04 DELMAR BOULEVARD <br /> <br />Chairperson Kreishman asked Mr. Goldman to comment on this agenda item. Mr. Goldman <br />explained that the applicant requested extension of time to complete work required under the <br />Conditional Use Permit which expired on March 18, 1991. He went on to state that the matter <br />was referred to the Plan Commission by the City Council and was placed on the April 24 <br />agenda. He explained that a letter from Mr. Mayer Klein, President of Agudas Israel was <br />distributed to the Plan Commission requesting a postponement to the May meeting; which was <br />granted. <br /> <br />Chairperson Kreishman asked if anyone was present to represent Agudas Israel and there was <br />no reply. After a brief discussion Mr. Foxworth moved that the Plan Commission recommend <br />denial of the extension to Conditional Use Permit #276. Mrs. Ratner seconded the motion which <br />passed by a vote of 5-0, with Mr. Safe abstaining from the vote. <br /> <br />PROPOSED AMENDMENT TO THE DELMAR LOOP URBAN RENEWAL PLAN <br /> <br />Chairperson Kreishman called on Mary Fahey, Executive Director of the University City <br />Redevelopment Authority (UCRA), who explained that a proposed expansion of the Mid- <br />America Steel Company (MASCO), 6601 Vernon, included truck access to the property from <br />Westgate which is in violation of the land use regulations governing the Delmar Loop Urban <br />Renewal Plan. She went on to explain that the UCRA, over the strong objection of the staff, <br />approved an amendment to the Delmar Loop Urban Renewal Plan on April 23, 1991 to allow <br />the vehicular access to the property from Westgate.
