The landscaping was installed <br />as of 4:00 p.m. this evening. <br /> <br />Mr. Hill verified that the landscaping had, in fact, been installed. <br /> <br />Chairperson Kreishman asked Mr. Goldman to report on the staff review. Mr. Goldman stated <br />that the applicants wished to amend their Conditional Use Permit for a carry-out restaurant by <br />changing Condition No.1 to allow barbecuing of meat on the premises and Condition No.9 to <br />extend the hours of operation to 2 a.m., seven days per week. If the exhaust system meets the <br />requirements of Condition No.6, the barbecuing of meat at the facility at Olive and <br />Pennsylvania should not create a problem. Regarding the hours of operation, he does not <br />believe it is in the community interest to extend hours to 2 a.m. on any day of the week. An <br />isolated freestanding commercial facility of this type, operating during early morning hours <br />appears to be an open invitation for robbery. He recommends the approval of the request to <br />cook meat on-premises and rejection of the request for extension of hours. <br /> <br />The Chairperson asked the members of the Commission if they had questions for Mr. Goldman <br />about his staff recommendation or to the applicant. Ms. Ratner asked whether the air-filtration <br />system is in operation now. Mr. Bell replied that it was. Ms. Ratner asked the staff whether <br />there had been any formal complaints about the smell of the restaurant. Mr. Goldman and Mr. <br />Hill responded that the only complaints about the smell were those stated in the petition <br />presented by Monica Stewart at the February 26, 1992 meeting. <br /> <br />Monica Stewart, 1066 Pennsylvania, stated that the odor is not constant, but you can tell when <br />U-City BBQ is cooking. Mr. Bell replied that any odors neighbors smell probably come from <br />the nearby pizza or chinese restaurants. <br /> <br />Mr. Bell stated that he didn't understand why Mr. Goldman still recommended against the <br />request for an increase in hours since the landscaping had been installed, as requested, prior to <br />this meeting. Mr. Goldman stated that the increase in hours and the installation of landscaping <br />are two totally separate issues. The Commission members stated that they would not consider <br />Mr. Bell's request until all of the conditions of the original permit were met. <br /> <br />Mr. Bell assured the Commission members that at least 3 - 4 employees would be present at all <br />times during the late-night hours. <br /> <br />Ms. Kreishman asked why the Bells thought business would increase 30% - 40% with the <br />increase in hours. Mrs. Bell stated that they would have the business of customers who work <br />late or are just getting off of a late-shift. Mr. Bell stated that it was customary for a barbecue <br />restaurant in the black community to stay open late. Also the "night" crowd will be served. <br />Mrs. Bell presented a petition, signed by customers in favor of the increase in hours. <br /> <br />m-J-25.plc <br />
