<br />. <br /> <br />. <br /> <br />April 22,1992 Plan Commission Meeting Minutes Page 6 <br /> <br />The motion was seconded by Mr. Safe and passed by a vote of 6 - O. <br /> <br />PUBLIC HEARING FOR CONDITIONAL USE AMENDMENT #156A - RESTAURANT <br />EXPANSION. 6847 OLIVE <br /> <br />Chairperson Kreishman informed those present that the Plan Commission had scheduled the <br />public hearing on an application from William Simmons for Amendment of Conditional Use <br />Permit #156A for 6847 Olive in order to expand the use of his carry-out restaurant to include <br />on-premise dining. The Chairperson outlined the Commission's procedures and criteria for <br />reviewing conditional use permits and called for testimony from the applicant. <br /> <br />Mr. William Simmons who runs the Sea Haven Restaurant stated that he has been open at that <br />location for 15 years and wishes to expand his operation into the vacant unit next door in order <br />to allow on premise dining. 42 seats will be added. He has also made arrangements to have <br />the parking lot expanded but will need approximately six months to raise the funds to do that. <br /> <br />Chairperson Kreishman asked Mr. Goldman to report on the staff review. Mr. Goldman <br />explained that the adequacy of off-street parking is the major concern with this application. A <br />minimum of 11 off-street parking spaces are required for the dining area and at least an <br />additional 5 spaces for the pick-up counter for a total of 16 parking spaces. A minimum of an <br />additional 15 spaces is required for the balance of the shopping strip if the space remains retail. <br />If the proposed parking lot is built, parking should be reasonably adequate. No landscape <br />information has been submitted, nor are refuse storage boxes shown on the site plan. He stated <br />that the City has received no complaints regarding cooking odors from the present establishment <br />and the proposed hours of operation with a 9 p.m. closing time are acceptable. He recommends <br />approval of the permit with the conditions stated in his written staff recommendation. <br /> <br />Mr. Kendall asked what the current hours of operation are. Mr. Simmons replied that they are <br />currently open from 11 a.m. to 11 p.m. at night but they will be changing that. Mr. Kendall <br />suggested that the hours should remain the same. <br /> <br />The Chairperson asked for comments from the public. No comments from the public were <br />made. The public hearing was closed. <br /> <br />Ms. Kreishman stated that she wants the new parking lot to have a 10' buffer strip on the east <br />and north sides that abut residential properties. However, that would require a reduction in the <br />amount of parking offered to 27 spaces. <br /> <br />Ms. Ratner moved that the Plan Commission recommend approval of the Conditional Use Permit <br />subject to the following conditions: <br /> <br />1. Off-street parking for not less than 27 automobiles shall be provided. A ten foot <br />transitional yard, buffer strip shall be installed between the north and east sides of the <br /> <br />m-4-22.plc <br />
