The project shall be operated and maintained in accordance with a detailed maintenance <br />plan and schedule submitted to and approved by the City Manager. <br />7. Landscaping shall be installed and maintained in accordance with a detailed landscape <br />plan submitted to and approved by the Planning Director. <br />8. Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light <br />upon any property located in a residential district. Exterior lighting shall be installed and <br />maintained in accordance with a detailed lighting plan submitted to and approved by the <br />Planning Director. <br />9. Late hour and overnight parking shall comply with a traffic and parking plan submitted <br />to and approved by the City Manager. <br />10. There shall be no expansion of facilities, building of additions or new buildings, and no <br />additional drives or parking other than as shown on plans approved for this Conditional <br />Use Permit, without the approval of the City Council following a recommendation from <br />the Plan Commission after a Conditional Use public hearing. <br />II. Backer and George Avenues shall remain closed off from the site. <br /> <br />The motion was seconded by Mr. Marsh and passed by a vote of 7 - O. <br /> <br />PUBLIC HEARING FOR CONDITIONAL USE PERMIT #307 - CHURCH. 7740 OLIVE <br /> <br />Chairperson Kreishman informed those present that the Plan Commission had scheduled the <br />public hearing on an application from Higher Heights Christian Church represented by Bettye <br />Battle-Turner for Conditional Use Permit #307 for 7740 Olive in order operate a church. The <br />Chairperson outlined the Commission's procedures and criteria for reviewing conditional use <br />permits and called for testimony from the applicant. <br /> <br />Bettye Battle-Turner, attorney for Higher Heights Christian Church, stated that the church is <br />relocating to the building at 7740 Olive from their present church at the corner of Kingshighway <br />and McPherson. They will use the facility for church services and church-related activities. <br />The facility currently has a seating capacity for 576 persons. The parking lot has approximately <br />75 parking spaces. She states that they will be able to obtain, through agreements with Car-X <br />and the Plumber's Association, an additional 42 spaces. She stated that their application gives <br />the details of the proposed use and that they are willing to comply with conditions and <br />ordinances of the City. <br /> <br />Chairperson Kreishman asked Mr. Hill to report on the staff review. Mr. Hill stated that <br />current off-street parking is limited to approximately 75 spaces. The area along the west side <br />of the building cannot be considered as off-street parking since there is less than 3 feet between <br />the building and the street right-of-way. The present lot as marked will hold 68 spaces. With <br />modifications it may be possible to add a few more spaces to bring the total up to 75 spaces. <br />The layout furnished by the applicant does not work. The stalls are too small, the major aisles <br />are too narrow, and the spaces along Riegert are in the right-of-way. A sidewalk and curbing <br /> <br />m-8-26.plc <br />
