<br />. <br /> <br />. <br /> <br />September 23,1992 Plan Commission Meeting Minutes Page 3 <br /> <br />The Chairperson asked for comments from the public. June Goldman, 1215 Mt. Olive, stated <br />that her bedroom window is located approximately 30' from the proposed restaurant's rear door. <br />She states that there has been trash and rodent problems behind the site. The trash was collected <br />at 2 a.m. disturbing the neighborhood. The parking is already congested because of the Mt. <br />Olive Tavern and will only get worse with a carry-out restaurant. She further stated that <br />somebody from the city should check dangerous wires coming from the roof of the building. <br /> <br />Carolyn Wilbert from the University City Chiropractic Centre, 7801 Olive, stated that she has <br />concerns about the already overcrowded parking in the complex. She is further concerned with <br />the litter from transient pedestrians walking across the front walkway. Security for their <br />building will be jeopardized if the restaurant will have customers until 10 or 11 p. m. Currently, <br />all the shops in the complex close at 6 p.m. Ms. Kreishman asked if the Chiropractic Centre <br />had a separate landlord from the three units to the west. Ms. Wilbert stated that they have <br />separate landlords and the buildings are separate. They are, however, connected in the front, <br />facing Olive. <br /> <br />Dr. Leonard Wilbert, the Chiropractor of University City Chiropractic Centre, 7801 Olive, <br />stated that many of his patients expressed concerns about parking because it is already crowded. <br />He stated that the Chiropractic Centre has a separate parking lot. He also expressed concerns <br />about litter and transient pedestrian traffic. <br /> <br />No more comments were made by members of the public and the public hearing portion of the <br />proceedings was closed. <br /> <br />Ms. Kreishman stated that the parking lot was filled at 4 p.m. when she stopped by that <br />afternoon. She further stated that her main concern was difficult automobile maneuvering <br />because of the driveway's access and limited visibility. Those problems make it an inappropriate <br />location because of the high volume of "in and out" traffic associated with a carry-out restaurant. <br />She will therefore vote against approval. <br /> <br />Ms. Ratner stated that she will also vote against approval but stated that the following conditions <br />should be added if City Council approves the permit: Condition 4 should further state, "No trash <br />shall be picked up between the hours of 5 p.m. and 8 a.m.; Condition 7 should further state, <br />"but should adequately light all areas of the lot"; a new Condition 8 should state, "The hours <br />of operation are limited to the hours between 8 a.m. and 11 p.m. "; and a new Condition 9 <br />should state the Conditional Use permit is limited to this applicant. <br /> <br />Mr. Marsh stated that he would be voting in favor of the proposal because he feels denial <br />penalizes this applicant for existing parking problems caused by a neighboring use. He feels the <br />location is appropriate and sees no appropriate reasons for denial. <br /> <br />Mr. Kendall stated that the applicant should be permitted to find a better location for the use. <br /> <br />m-9-23.plc <br />
