The lots across the street have a 45 foot building line and the <br />lots to the west have a 55 foot set back. The 25 foot building line is inconsistent with the <br />prevailing pattern. 2) The lot area for Lot B is 7,280 square feet. This is smaller than any of <br />the development on the north side which range from 7800 square feet to 10,500 square feet. <br />The developed lots on the south side of the block are more than 12,000 square feet in area. 3) <br />The Union Electric service drop serving Lot A is shown crossing through the buildable area of <br />Lot B. The ideal arrangement would be to provide a utility easement along the south side of Lot <br />B. 4) A 21 inch diameter sewer is shown in Lot A running parallel to the west lot line. A <br />utility easement should be provided for this sewer. 5) The preliminary plat does not show the <br />location of the houses at 7848 and 7849 Greensfelder. He is concerned that a house on Lot B <br />may have an awkward spacial relationship with these two existing houses. <br /> <br />Mr. Kennedy presented the Commission with a petition showing that nine out the fourteen <br />surrounding neighbors have approved the resubdivision. He stated that the others were not <br />home. Mr. Goldman stated that these two lots are not formally part of the private subdivision <br />of Teasdale Court. <br /> <br />Mr. Marsh asked if any members of the public wished to make comments. Bob Wagoner, 7848 <br />Greensfelder, stated that the spatial relationship of the Kennedy's current home and the proposed <br />home to his home (directly behind the Kennedy's) concerns him. Tom Harig, 7814 <br />Greensfelder, stated that he heard there may be an easement for access to the lot to come from <br />Greensfelder not Teasdale. He opposed that. He further stated that a different house was built <br />at 7906 Teasdale Court and it looked squeezed in. Mark Eckhardt, 7906 Teasdale Court stated <br />that he owned the house just referred to and is adjacent to the proposed new lot. He is in favor <br />of the resubdivision. Jeff Biskup, 7835 Greensfelder, stated that he owns the property directly <br />behind the proposed new lot and stated he was approached concerning the access easement to <br />Greensfelder. Mr. Carmody stated that any easements for access are not a part of this <br />application before the Commission. <br /> <br />Mrs. Kennedy stated that the 70' lot width is longer than most properties in the neighborhood. <br />The larger square footage from the other properties comes from their depth. <br /> <br />Mr. Marsh asked Mr. Goldman if the Commission has the power to increase the lot size <br />requirements or lot widths over the minimums required in the Zoning Code. Mr. Goldman <br />stated that in September of 1992, Ordinance 5880, requires that in the case of resubdivisions the <br />lot size and lot width should be in substantial conformance with the lots on the block frontage. <br /> <br />Ms. Peniston asked the applicant why the proposed house on the preliminary plat placed so close <br />to the street. Mr. Kennedy stated that the house on the preliminary plat was just an example <br />and that it could be placed anywhere within the building lines. <br /> <br />Mr. Marsh asked if the applicants would consider splitting the lot in half. Mrs. Kennedy stated <br />that she would not because they presently have a small back yard and need a large side yard to <br /> <br />m-4-28.plc <br />
