<br /> <br />. <br /> <br />. <br /> <br />Plan Commission Minutes, November 17, 1993 Page 2 <br /> <br />all applicable provisions of the Zoning Code; b) at the specific location will contribute to and <br />promote the community welfare or convenience; c) will not cause substantial injury to the value <br />of neighboring property; d) complies with the overall neighborhood development plan and <br />existing zoning district provisions; and e) will provide, if applicable, off-street parking and <br />loading areas in accordance with the standards contained in the Zoning Code. The Vice <br />Chairperson called upon the applicant. <br /> <br />Mr. Anthony Sansone, Ir. explained that he was developing the corner of Loop North and <br />Kingsland for use by Walgreens and part of the plan was to build a drive through facility on the <br />east side of the building for use by the pharmacy. He answered several questions from members <br />of the commission stating that 24 hour use of the drive-through was planned, that there would <br />be adequate lighting to insure security and that Walgreens would provide adequate security <br />personnel as is their normal practice. <br /> <br />Vice Chairperson Ratner called on Planning Director Al Goldman to provide the staff report. <br />He stated that the subject property is located in the "RC" - Retail Commercial Zoning District <br />which requires a Conditional Use Permit for a drive-through facility. He noted that the City <br />Council approved the overall project under the site plan review process, but could not give <br />approval of a drive-through facility without a recommendation from the Plan Commission under <br />the conditional use provisions of the code. Mr. Goldman recommended approval subject to a <br />condition that in the event the use of the drive-through facility for prescription drugs is <br />discontinued for a period of six (6) months, the drive-through window and other drive-through <br />accessories shall be removed and the parking lot to the east shall be reconfigured to provide at <br />least 15 additional parking spaces. All costs including paving, curb removal, curb installation <br />and striping the new parking stalls shall be borne by the owner of the development. <br /> <br />Vice Chairperson Ratner opened the public hearing and asked for testimony from the public. <br />No member of the public indicated a desire to be heard and the public hearing was closed. <br /> <br />Mr. Safe indicated his opposition to the proposed drive-through facility. He objected to the fact <br />that the building was not located on the Delmar frontage, was not pedestrian oriented, was not <br />consistent with the appearance of the area, and that a drive-through facility was inconsistent with <br />the urban character of the area. <br /> <br />Vice Chairperson Ratner questioned the adequacy of the landscape buffering and the lack of <br />sidewalks directly north of the building and stated that she did not find the application beneficial <br />to the area. She also indicated that she was not pleased that the conditional use application did <br />not come to the Plan Commission before the City Council acted to approve the Site Plan <br />Review. <br /> <br />Several citizens arrived late and Vice Chairperson Ratner reopened the public hearing to give <br />them an opportunity to speak. <br /> <br />M-1l-17.PLC <br />
