Storm water drainage shall conform to the requirements of the Building Code and <br />Metropolitan Sewer District. <br />5. The operator of the premises shall regularly police the site and the area adjacent to the <br />buildings to remove litter and debris. <br />6. Plans for exterior remodeling or color changes to the existing residential structure shall <br />be submitted to the Director of Planning for review and approval prior to occupancy, or <br />if initiated after occupancy prior to occurrence. <br /> <br />The motion was seconded by Mr. Foxworth and passed by a vote of 3 - 1 with one abstention, <br />with Ms. Kreishman, Mr. Kahn, and Mr. Foxworth voting "aye," Mr. Marsh voting "nay" and <br />Mr. Safe abstaining. <br /> <br />After the hearing was over, Beatrice and Claude Henton, 7422 Melrose, appeared and stated that <br />they wished to express their opposition to the rezoning and conditional use permit applications. <br />They were informed that the City Council would mostly likely be reviewing the matter on <br />February 28, 1994. They indicated they would appear at that meeting to express their views. <br /> <br />Public Hearing: Conditional Use Permit #315 for carry out and delivery restaurant at 8107 <br />Olive <br /> <br />Mr. Marsh left before this hearing started; Ms. Kreishman acted as Chairperson for this hearing. <br />Ms. Kreishman announced that a public hearing was scheduled to hear an application from Papa <br />John's International Inc. for a Conditional Use Permit for a carryout and delivery restaurant at <br />8107 Olive. <br /> <br />The Acting Chairperson noted the Commission's procedures and criteria for reviewing <br />conditional use permits. She specifically stated that the Plan Commission must consider whether <br />the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific <br />location will contribute to and promote the community welfare or convenience; c) will not cause <br />substantial injury to the value of neighboring property; d) complies with the overall <br />neighborhood development plan and existing zoning district provisions; and e) will provide, if <br />applicable, off-street parking and loading areas in accordance with the standards contained in the <br />Zoning Code. The Acting Chairperson called upon the applicant. <br /> <br />Mr. John Rose, Director of Corporate Leasing for Papa John's International, Inc. explained that <br />his corporation wished to open a carryout and delivery operation at that location. There are 410 <br />existing stores operating with approximately thirty stores currently opening in the St. Louis <br />metropolitan area. He stated that Papa John's is leasing the property from its current owner <br />with a five year lease. He emphasized that there will be very little odors from the property <br />since they only bake foods, not fry them. He stated that they usually do a lot of landscaping and <br />will comply with any such requirements from University City. He stated they will not have any <br /> <br />m-1-26.plc <br />
