Diane Pepper, District Manager and Charles Mayer, Architect were <br />introduced. <br /> <br />The Acting Chairperson called on Planning Director, Al Goldman to provide the staff report. <br />Mr. Goldman stated that the property no longer has standing as a carry-out restaurant and must <br />be approved under the conditional use provisions of the zoning code before it can be used as a <br />carry-out restaurant. The application indicates that the typical hours of operation are 11:00 a.m. <br />to 12:00 midnight, seven days per week. No information was submitted on proposed signing <br />or any changes to the exterior appearance of the building. The property was developed without <br />a transitional yard on the north although there is a six foot high fence screening the commercial <br />activities from the house to the north. The existing landscaping is acceptable except that at least <br />two trees should be planted on the Olive frontage and one on Hafner. Based on the fact that this <br />property was developed for carry-out service and remains in fairly good condition, approval is <br />recommended subject to the following conditions: 1) An exhaust system shall be installed or <br />other means shall be taken to prevent any food preparation odors or cooking odors from being <br />perceptible beyond the property lines; 2) Signs for the restaurant shall strictly comply with the <br />provisions for the University City Sign Code. Sign permits shall be applied for and approved <br />prior to occupancy; 3) A detailed landscaping plan shall be submitted to the Director of Planning <br />for his review and approval prior to occupancy. Landscaping shall be installed and maintained <br />in accordance with the approved plan; 4) Trash containers for patron use shall be available on <br />the premises at all times and the operator shall regularly police the site and the neighborhood <br />adjacent to the restaurant to remove litter and debris; and 5) Plans for exterior remodelling and <br />color changes shall be submitted to the Director of Planning for review and approval prior to <br />occupancy. <br /> <br />The Acting Chairperson opened the public hearing and asked for testimony from the public. No <br />member of the public indicated a desire to be heard and the public hearing was closed. <br /> <br />Mr. Safe stated that the hours of operation should be limited to the hours which the applicant <br />thought they would be opened. After discussion between the applicant and Mr. Safe it was <br />decided that the hours of operation should be limited to after 9 a.m. each day and before 2 a.m. <br />the following morning. <br /> <br />Mr. Safe moved that the Plan Commission recommend approval of the Conditional Use Permit <br />subject to the following conditions: <br /> <br />1. An exhaust system shall be installed or other means shall be taken to prevent any food <br />preparation odors or cooking odors from being perceptible beyond the property lines. <br />2. Signs for the restaurant shall strictly comply with the provisions for the University City <br />Sign Code. Sign permits shall be applied for and approved prior to occupancy. <br />3.
