MSD, State and County highway approvals shall be obtained prior to the issuance of <br />building permit. <br />7. The building permit for the building addition shall be obtained no later than May 31, <br />1995. <br />8. If the building addition is built, the grades and drainage along the southern edge of the <br />site shall be revised to minimize the steepness of the sloped paving. The revised grades <br />shall be submitted to the Director of Planning for review and approval. <br />9. If the building addition is built, the new trash enclosure shall be constructed of masonry <br />to match the building and shall be large enough to include space for a trash dumpster, <br />worn tires and scrap metal; and shall be relocated within the area directly south of the <br />building, as required by the revised grades. <br /> <br />The motion was seconded by Mr. Foxworth and passed by a vote of 4 to O. <br /> <br />Public Hearing: Conditional Use Permit Application #319 for Carry-out/Delivery <br />Restaurant, 7359 Forsyth <br /> <br />Mr. Mark Mottaz President of Sub-One Inc., asked to recognized and proposed to the Chair that <br />the order of the agenda be changed to hear the Imo's Pizza application before the Sub-One <br />application. After checking with the representative's from Imo's Pizza and asking if any <br />member of the public objected (there were no objections) Chairperson Pro Tern Solodar agreed <br />to hear Conditional Use Application #319 before #318, and opened the public hearing by calling <br />on Mr. Donald Anderson, attorney at law representing Forsyth Pizza Inc. Mr. Anderson asked <br />that the application from Forsyth Pizza Inc, including amendments stated by Mr. Anderson, and <br />~34-65.4 of the University City Zoning Code be part of the record that is forwarded to the City <br />Council. He then reviewed the staff recommendations making the following comments: <br /> <br />1) The applicant will comply with the University City sign code. 2) The work shown on the <br />public sidewalk is not part of this application. 3) The application is amended to provide for <br />starting the operation at 10:00 a.m. daily. 4) All deliveries will be at the rear with a maximum <br />of 5 drivers working at anyone time. 5) The applicant will not provide a separate trash <br />dumpster as stated in the application, but will use the common trash dumpster furnished by the <br />property owner which will be emptied daily. 6) The operator will police the site to remove <br />litter and debris. 7) Trash containers will be provided for patrons. 8) The operator will <br />comply with all performance standards including a 70 db limit on sound. <br /> <br />Chairperson Pro Tern Solodar then called on Mr. Goldman for the staff report. Mr. Goldman <br />noted that the applicant's representative had reviewed his recommendations and that he had no <br />objection to the proposed amendments. <br /> <br />Before opening the floor to comment, from the public, Mr. Solodar asked if there was any need <br />to repeat the explanation of the Plan Commission's procedures or the criteria for review of <br /> <br />m-6-22.plc <br />
