<br />. <br /> <br />. <br /> <br />6-22-94 Plan Commission Meeting Minutes Page 5 <br /> <br />Conditional Use Permit applications that was stated by Mr. Goldman at the beginning of the <br />previous agenda item. These were no requests to repeat this information and the floor was <br />opened for public comments. <br /> <br />Mr. Robert Fischel of 7320 Lindell was concerned with curbside parking for deliveries, <br />particularly the potential for large trucks creating a vision obstruction for automobiles coming <br />out of Lindell. He was also concerned about delivery vehicles using Lindell as a short cut. Mr. <br />David Gore, Vice President of Forsyth Pizza responded that all deliveries would be made to the <br />rear of the store. <br /> <br />Mr. Jerry Murray of 7322 Lindell wanted to know what the building will look like and the <br />applicant showed the drawings of the building which is about to be constructed. Mr. Murray <br />was also concerned about Imo's delivery personnel using Lindell and asked about prohibiting <br />such traffic. Council member Schoomer commented that if traffic problems should occur, <br />neighbors should contact the traffic commission which can then study the problem and make <br />recommendations to the City Council for enacting parking or traffic regulations. <br /> <br />Mr. Solodar pointed out that the general parking lot was mainly used by Vic Tanny's clients. <br />Mr. Gore responded that Imo's Pizza planned to limit customer access to the front door on <br />Forsyth which would encourage the use of the parking spaces that are close to the Forsyth <br />sidewalk and thus the Vic Tanny use will not be a problem. <br /> <br />The Chairperson Pro Tern closed the public hearing and asked for discussion from the members <br />of the Plan Commission. <br /> <br />Mr. Kahn stated that daily refuse collection should be a requirement if only one dumpster is to <br />be used. He thus moved approval of the application as amended based on fact that the evidence <br />supported a finding that the proposed Conditional Use will meet the standards for approval <br />contained in ~34-65.4; subject to the following conditions: <br /> <br />1. Signs on the premises shall conform in all respects with the provisions of the University <br />City Sign Code. <br />2. This permit does not authorize the raised platform, stairs, planters or lighting on the <br />public sidewalk as shown on the application drawings. <br />3. The hours of business operation shall be limited to starting business no earlier than 10:00 <br />a.m. on any day of the week, closing by midnight on Sunday through Thursday nights <br />and closing by 1:00 a.m. the following morning on Friday and Saturday nights. <br />4. All delivery vehicles shall park at the rear of the building and use the rear doors only. <br />5. The operator of the restaurant shall be responsible to insure daily collection from the <br />refuse container if not otherwise provided by the building owner. <br />6. The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br /> <br />m-6-22.plc <br /> <br />
