An exhaust system shall be installed and/or other means shall be taken to prevent any <br />food preparation odors or cooking odors from being perceptible beyond the lot lines of <br />the lines of the property on which the restaurant is located. <br /> <br />The motion was seconded by Ms. Peniston and passed by a vote of 4 to O. <br /> <br />Public Hearing: Conditional Use Permit Application #318 for Carry-out/Delivery <br />Restaurant, 7351 Forsyth <br /> <br />Chairperson Pro Tern Solodar opened the public hearing by noting that the same procedures and <br />criteria would govern this hearing as was announced for previous hearings. He then called on <br />Mr. Mark Mottaz, President of Sub-One Inc. Mr. Mottaz explained the application, noting that <br />the Sub-One operation consists of a delivery restaurant primarily serving sandwiches and soft <br />drinks and that there will be no grills or frying equipment. The proposed hours of operation are <br />from 10:00 a.m. to 2:00 a.m. 7 days a week. All sales will be for carry-out and delivery and <br />that there will be no eating on the premises. <br /> <br />Chairmen Pro Tern Solodar then called on Mr. Goldman to give the staff report. Mr. Goldman <br />reviewed the report with the Plan Commission stating that he found the proposed Conditional <br />Use will meet the standards for approval as set out in Zoning Code ~34-65.4 if the Conditional <br />Use is limited by the following conditions: 1) Signs on the premises shall conform in all <br />respects with the provisions of the University City sign code. 2) The permit does not authorize <br />the raised platform, stair, planters or lighting of the public side walk as shown on the application <br />drawings. 3) The hours of business operation shall be limited to 10:00 a.m. to 2:00 a.m. every <br />day of the week. 4) All delivery vehicles shall park at the rear of the building and use the rear <br />doors only. 5) The operator of the restaurant shall regularly police the site and the area <br />adjacent to the restaurant to remove litter and debris. 6) Trash containers for patron use shall <br />be available on the premises at all times. 7) An exhaust system shall be installed and/or others <br />means shall be taken to prevent any food preparation odors or cooking odors from being <br />perceptible beyond the lot lines of the property on which the restaurant is located. <br /> <br />Mr. Mottaz responded that he concurred with all of the staff recommendations but pointed out <br />that his restaurant had no interest or concern regarding the raised platform and stairs on the <br />public sidewalk dealt with in Condition #2. Mr. Kahn suggested that the hours be changed to <br />be the same as those that were just approved for the lmo's restaurant. The applicant indicated <br />he has no objection to the more restrictive hours. <br /> <br />Ms. Peniston moved approval based on the fact that the evidence supported a finding that the <br />proposed Conditional Use will meet the standards for approval contained in Zoning Code ~34- <br />65.4; subject to the following conditions: <br /> <br />m-6-22.plc <br />
