Mr. Goldman <br />stated that the issue of the flood way was not resolved to his satisfaction but acknowledged that <br />the building question is probably out of the area of the floodway. He stated that any review <br />from Metropolitan Sewer District should include their recommendation for storm water detention <br />and such recommendations should be incorporated into the project in order to slow the flow of <br />storm water into the River Des Peres to prevent flash flooding. He stated that the code limits <br />sign heights to 10 feet and that the existing 16 foot high sign can technically be considered as <br />"grandfathered," he recommended that all signs be limited to those which comply with the <br />current sign code. The 10' sign height is more effective now that trees are planted along Olive. <br /> <br />Mr. Goldman stated that he found the proposed Conditional Use will meet the standards for <br />approval set out in Zoning Code ~34-65.4 if it is limited to the following conditions: <br /> <br />1) Site work shall not be started and no building permit shall be issued until a development <br />permit is issued by the local administrator of the City Flood Plain Management Ordinance. 2) <br />Locate the refuse/storage enclosure outside the limits of the floodway. 3) Curb cuts shall be <br />as approved by the State Highway Department. 4) Site work shall not be started and no <br />building permit shall be issued without first obtaining the approval of MSD. Special attention <br />shall be given to storm water discharge and storm water detention shall be provided in <br />accordance with MSD recommendations. 5) A detailed landscaping plan shall be submitted to <br />the Director of Planning for his review and approval. Landscaping shall be installed and <br />maintained in accordance with the approved plan. 6) Signs shall comply with the University <br />City Sign Code in every respect; and strips of lighting shall not be used to outline architectural <br />element such as edges of roof beams in a manner that is currently used on the existing building. <br />This is to be the ruling of the City Council and is not subject to an appeal to the Board of <br />Adjustment. 7) The operator of the restaurant shall regularly police the site and the area <br />adjacent to the restaurant to remove litter and debris. 8) Trash containers for patron use shall <br />be available on the premises at all times. 9) An exhaust system shall be installed and/or other <br />means shall be taken to prevent any food preparation odors or cooking odors from being <br />perceptible beyond the property line. 10) Lighting fixtures for parking lot and driveway shall <br />be shaded to prevent casting direct light on neighboring residential property. 11) Hours of <br />operation shall be limited to the hours of 6:00 a.m. to 11:00 p.m. on Sunday through Thursday <br />and 6:00 a.m. through 12:00 midnight on Friday and Saturday. 12) All exterior speakers shall <br />have adjustable volume controls and shall be so placed and operated so as to avoid disturbing <br />the quiet of residents in the area. <br /> <br />Chairperson ProTem Solodar asked for public comments. No member of the public asked to <br />be heard and he closed the public hearing. <br /> <br />Mr. Kahn indicated that he thought that the speaker provisions should be kept in the conditions <br />to cover any future consideration of changes and he also felt the same way about the lighting of <br />architectural elements.
